a. Approve and authorize the Director of Health Services or designee to execute a retroactive three (3) year Standard Agreement with Keith Vandevere, Attorney-At-Law, to provide hearing officer services for the Behavioral Health Bureau in the amount of $75,000 for FY 2025-2026, $75,000 for FY 2026-2027, and $75,000 for FY 2027-2028, for a maximum County obligation of $225,000 for the term of July 1, 2025 through June 30, 2028; and
b. Approve and authorize the Director of Health Services or designee to execute up to three (3) future amendments that do not exceed 10% ($22,500) of the original Agreement, do not significantly change the scope of services, and do not increase the total not to exceed maximum amount over $247,500.

RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute a retroactive three (3) year Standard Agreement with Keith Vandevere, Attorney-At-Law, to provide hearing officer services for the Behavioral Health Bureau in the amount of $75,000 for FY 2025-2026, $75,000 for FY 2026-2027, and $75,000 for FY 2027-2028, for a maximum County obligation of $225,000 for the term of July 1, 2025 through June 30, 2028; and

SUMMARY/DISCUSSION
The Lanterman-Petris-Short Act mandates a certification review hearing for all persons to be certified for involuntary mental health treatment. Keith Vandevere, Attorney-At-Law, provides services as the hearing officer for certification review hearings.
