RECOMMENDATION:
It is recommended that the Board of Supervisors:
Adopt an ordinance amending section 12.12.010 of the Monterey County Code to decrease an existing speed limit on a portion of Reservation Road in the unincorporated area of the County of Monterey from 55 miles per hour to 50 miles per hour. The 50 miles per hour limit will apply from milepost 0.82 generally southeast to a point 685 feet southeast of the centerline of East Garrison Drive (milepost 1.72).

SUMMARY/DISCUSSION:
On September 11, 2012, the Board introduced, waived the reading, and set today’s date and time to consider adoption of the ordinance amending section 12.12.010 of the Monterey County Code to decrease an existing speed limit on a portion of Reservation Road in the unincorporated area of the County of Monterey from 55 miles per hour to 50 miles per hour.

Pursuant to Article XI, section 7 of the California Constitution, the County of Monterey may adopt and enforce ordinances and regulations not in conflict with general laws to protect and promote the public health, safety, and welfare of its citizens. Pursuant to California Vehicle Code section 22358 (a), the County of Monterey may by ordinance determine and declare upon the basis of an engineering and traffic survey a prima facie speed limit of 60, 55, 50, 45, 35, 30, or 25 miles per hour, whichever is most appropriate to facilitate the orderly movement of traffic and is reasonable and safe.
