RECOMMENDATION:
It is recommended that the Board of Supervisors:
Continue the date and time for hearing of the Pebble Beach Company's Appeal of Tax Penalty from Tuesday, November 6, 2012, at 10:30 a.m. in the Monterey County Board of Supervisors Chamber located at 168 W. Alisal St., Salinas, CA 93901 to a date to be determined and set in the first half of calendar year 2013.
 
SUMMARY/DISCUSSION:
Pursuant to Monterey County Code section 5.40.130, the Board of Supervisors received an appeal from the Pebble Beach Company from the decision of the Monterey County Tax Collector denying their administrative appeal of the imposition of a Transient Occupancy Tax Late payment penalty.  In order to facilitate the implementation of appropriate hearing rules and guidelines for such appeal hearings, the currently scheduled hearing set for November 6, 2012 at 10:30 am will need to be continued to a date to be set in early 2013.
 
 
OTHER AGENCY INVOLVEMENT:
The Treasurer-Tax Collector concurs in this recommendation.
 
 
FINANCING:
There are no financing issues related to the recommendation.
