a. Approve and authorize the Director of Health Services or designee to ratify the executed Participation Agreement No. 12725-MONT-PICR-25_26 between the County of Monterey and the California Mental Health Services Authority for the provision of psychiatric inpatient authorization services, for a maximum County obligation of $268,968 for the term of July 1, 2025 through June 30, 2026; and
b. Approve and authorize the Director of Health Services or designee to execute up to three (3) future amendments that do not exceed 10% ($26,896) of the original agreement, do not significantly change the scope of services, and do not increase the total not to exceed amount over $295,864.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to ratify the executed Participation Agreement No. 12725-MONT-PICR-25_26 between the County of Monterey and the California Mental Health Services Authority for the provision of psychiatric inpatient authorization services, for a maximum County obligation of $268,968 for the term of July 1, 2025 through June 30, 2026; and
b. Approve and authorize the Director of Health Services or designee to execute up to three (3) future amendments that do not exceed 10% ($26,896) of the original agreement, do not significantly change the scope of services, and do not increase the total not to exceed amount over $295,864.
SUMMARY:
Participation Agreement No. 12725-MONT-PICR-25_26 must be ratified to make whole the status of its execution. The Participation Agreement, which maintains a total NTE amount of $268,968 for FY 2025-26, was inadvertently and erroneously approved and executed under the auspices of Board Order No. 34 pertaining to Agreement No. A-17338, wherein the Director of Health Services or designee may execute subcontractor agreements associated with the California Mental Health Services Authority that are not in excess of $200,000.
