RECOMMENDATION:
It is recommended that the Board of Supervisors:
As code reviewing body, adopt a Resolution approving the proposed amendment of the Monterey County Counsel's Conflict of Interest Code.
SUMMARY/DISCUSSION:
The Political Reform Act of 1974 (Government Code section 81000, et. seq.), requires state and local government agencies to adopt Conflict of Interest Codes and to periodically review and make necessary changes to their codes. Amendments to the County Counsel's Conflict of Interest Code are authorized by Government Code section 8730 whenever changes are required by changed circumstances, by creation or deletion of designation positions, or by changes in the duties of designated positions. Position and title changes have occurred at County Counsel since August 2018, when its Conflict of Interest Code was last amended. Thus, there is need to amend its code to accurately reflect the current designated positions and titles.
Pursuant to Government Code sections 82011 and 87303, the Board of Supervisors is the code reviewing body. It may approve the Code as submitted, revise the proposed Code and approve it as revised, or return the proposed Code to the agency for revision and resubmission. The proposed, amended Code is attached for review and approval. Staff recommends that the Board of Supervisors approve the proposed amended Conflict of Interest Code of the Monterey County Counsel.
OTHER AGENCY INVOLVEMENT:
County Counsel represents that the proposed Code, as submitted, is lawful under the Political Reform Act of 1974.
FINANCING:
There is no financial impact upon the County of Monterey resulting from the Board's approval of the proposed amendment to the Monterey County Counsel's Conflict of Interest Code.
