RECOMMENDATION:
It is recommended that the Board of Supervisors, as the code reviewing body, approve the amended Conflict of Interest Code of the Carmel Area Wastewater District.
SUMMARY:
Onn July 30, 2026, the Carmel Area Wastewater District adopted a Conflict of Interest Code. As the Code Reviewing Body, the Board of Supervisors must approve this Conflict of Interest Code to render it effective.
DISCUSSION:
Under Government Code section 87300, agencies are required to “adopt and promulgate a Conflict of Interest Code.” Consequently, on July 30, 2026, the Carmel Area Wastewater District adopted a new Conflict of Interest Code. Under Government Code section 87303, the Code Reviewing Body, the Code Reviewing Body must approve this Conflict of Interest Code to render it effective. Under Government Code section 82011, the Board of Supervisors is the Code Reviewing Body for any agency “with jurisdiction wholly within the county,” which includes the Carmel Area Wastewater District.
Consequently, pursuant to sections 82011 and 87303 of the Government Code, the Board of Supervisors is the code reviewing body and may approve the Code as submitted, revise the proposed Code and approve it as revised, or return the proposed Code to the agency for revision and resubmission.
The Office of the Monterey County Counsel has reviewed and approved the new Code. The Proposed Conflict of Interest Code of the Carmel Area Wastewater District is lawful under the Political Reform Act of 1974. Staff therefore recommends that the Board approve this Proposed Code.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
County Counsel has reviewed and approved the proposed Code as to form.
FINANCING:
Approval of this new Conflict of Interest Code will have no financial impact upon the County of Monterey.
