RECOMMENDATION:
It is recommended that the Board of Supervisors adopt a resolution accepting ownership by County of Monterey of all fixed structures, buildings and/or site improvements constructed by the Sports Car Racing Association of the Monterey Peninsula (SCRAMP) at Laguna Seca raceway.
 
SUMMARY/DISCUSSION:
The concession agreement between the County of Monterey and SCRAMP stipulates various provisions related to the operation of the Laguna Seca raceway, pit area, race related facilities and public park areas.  Article 8 "Ownership of Improvements and Personal Property," Section 8.01 2 provides that " All planned fixed structures, buildings and/or site improvements constructed by SCRAMP on the property and their rights of ownership shall be transferred to the County upon Notice of Completion by SCRAMP and acceptance by the County."  Staff has reviewed the status of various SCRAMP constructed improvements and recommends that it is appropriate for the Board of Supervisors to deem the Notice of Completion from SCRAMP received and accept ownership of all fixed structures, buildings and/or site improvements constructed by SCRAMP on real property owned by the County of Monterey.
 
OTHER AGENCY INVOLVEMENT:
This matter has been coordinated with County Counsel.
 
FINANCING:
The recommended action will create no impact on the General Fund.
