Adopt the Negative Declaration for the proposed
Ordinance adding Chapter 10.42 to the Monterey
County Code.

WHEREAS, the County is char ed with protecting the public health, safety, welfare and
the environment by promoting the reduction of solid waste generation and the diversion of solid
waste from landfills. The Integrated Waste Management Act of 1989 Public Resources Code
section 41750 et seq) requires the County to divert its solid waste from landfills through source
reduction, recycling, and composting activities.
WHEREAS, the County is consi ering adoption of an ordinance adding Chapter 10.42 to
the Monterey County Code to establish regulations restricting the use of polystyrene foam food
packaging by food providers in the unincorporated area of the County of Monterey
PLN090146);
WHEREAS, County staff prep ed an Initial Study/Proposed Negative Declaration on the
proposed ordinance pursuant to the California Environmental Quality Act CEQA). Issues that
were analyzed in the Initial Study include: aesthetic resources, agricultural resources, air quality,
biological resources, cultural resources, geology and soils, hazards/hazardous materials,
hydrology/water quality, land use and lanning, mineral resources, noise, population and housing,
public services, recreation, traffic and tr nsportation, utilities and service systems.
WHEREAS, the Initial Study/ roposed Negative Declaration was circulated for public
review from November 13, 2009 through December 21, 2009. The County received nine letters in
support of eliminating the use of polystyrene foam food packaging and one letter questioning the
Initial Study and proposed ordinance.
