Amending Article I.b. of the Monterey County Master

Fee Resolution effective July 1, 2011, to adjust the

Sexual Assault Response Team examination fee

pursuant to the Fee Schedule 

THE MONTEREY COUNTY BOARD OF SUPERVISORS FINDS:

26

A. Section 1.40.010 of Chapter 1.40 of Monterey County Code provides that all fees, penalties,

refunds, reimbursements and charges of any kind by the County may be specified in the Monterey

County Fee Resolution.

B. The Health Department has Sexual Assault Response Team SART) examination and service fees

which are appropriate pursuant to Penal Code section 13823.95 to specify in the Monterey County

Master Fee Resolution, Article I.b. for fiscal year 2011-12.

C. This action to modify charges to meet operational expenses is statutorily exempt from

environmental review Pub Res. Code sec. 21080 subd. b)(8)].

D. Any and all adjustments to charges for SART related services reflect no more than the actual cost

of the service or benefit received by the payor.

E. By definition, these SART service charges are not a tax' and are exempt from voter approval

pursuant to Section 1 a)(4) of Article XIII C section 1(e)(2)-(3) of the California Constitution

Prop. 26; charge imposed for specific service or reasonable regulatory/investigatory costs

provided to or for the payor).

THE MONTEREY COUNTY BOARD OF SUPERVIOSRS RESOLVES:

1. Article I.b. of the Monterey County Fee Resolution is amended effective July 1, 2011 for Fiscal

Year 2011-12 with all schedules, tables, fees, taxes, penalties, and charges contained therein are

hereby adopted as described in the attachment to this resolution.

II. All prior resolutions regarding such fees are hereby repealed.

PASSED AND ADOPTED on this 17th day of May, 2011, upon motion of Supervisor Salinas, seconded

by Supervisor Armenta, by the following vote, to wit:

AYES: Supervisors Armenta, Calcagno, Salinas, Parker, and Potter

examination fee pursuant to the attached Fee Schedule.

RECOMMENDATION:

It is recommended that the Board of Supervisors adopt a Resolution amending Article I.b. of the

Monterey County Master Fee Resolution effective July 1, 2011, to adjust the Sexual Assault Response

Team examination fees pursuant to the attached Fee Schedule.

SUMMARY

The Health Department has operated the Sexual Assault Response Team SART) Program since July

1, 2007, and no adjustments have been made to the fee schedule since July 2007. Pursuant to Penal

Code section 13823.95, the County charges local law enforcement agencies in order to recover a

portion of the cost associated with performing forensic examinations and testifying in court at their

request. The Health Department requests that the existing fees for examination including photography

fee be increased to $925.00 from $625.00 in order to more closely represent the actual cost of the

service and recoup, while not exceeding the reasonable costs to the County for that service. We are

also requesting a SART readiness retainer fee be added to the fee resolution.

DISCUSSION:

The Sexual Assault Response Team SART) has existed in the County of Monterey since 1998. It was

initially managed under the auspices of the Natividad Medical Center Foundation, then in 2000 it was

managed by the Visiting Nurses Association through a contract with the County of Monterey Office of

the District Attorney, and then in 2007 the program was transferred to the Health Department.

When the Health Department took over operation of SART on July 1, 2007, there was a transfer in

appropriation of $211,214 of Tobacco Master Settlement Agreement Funds from the Office of the

District Attorney to the Health Department to cover costs associated with operating SART. Combined

with the recovery of fees from law enforcement allowed pursuant to Penal Code section 13823.95, the

SART program has been traditionally fully funded with no need for a supplemental General Fund

contribution.

The cost to operate Health Department programs has continued to rise and is expected to continue at

the current level of increase in FY 2011-12. As a result, the Health Department's cost for providing

services across the board is being evaluated to ensure that fees are reflective of current operation costs.

Due to an increase in baseline costs and a reduction of Tobacco Master Settlement Agreement Funds

to $160,000 for Fiscal Year 2011-12, the Health Department is now requesting that the SART fees be

adjusted to more closely reflect while still not fully meeting) the cost for providing those specific

services. It is therefore requested that the SART's victim and suspect examination including

photography fee be increased to $925.00 from $625.00 per exam, and that the fee schedule have added

to it an annual readiness retainer fee of $2,000 per law enforcement agency per year in order to

cost of the services provided to that payor. The readiness retainer fee will be invoiced to each law

enforcement agency at the beginning of each fiscal year, which will be credited for services provided

up to this amount.

If the proposed fee adjustment is not approved by your Board, the Health Department will need to

make operational adjustments to the SART program to reduce expenditures with an associated

reduction in service level. The requested adjustments facilitate only the cost recovery of the

reasonable costs associated with the service, but do not exceed, the fully loaded costs associated with

the program, and more accurately reflect the burden on the program associated with the level of use by

each of the payors.

The current cost per exam is approximately $3,600 and with the use of $160,000 Tobacco Settlement

the recommended fees are estimated to cover the remaining costs. It is requested that the fees take

effect July 1, 2011. A copy of the fee schedule is on file with the Clerk of the Board.

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed, and approved as to legal form, the proposed amendment to the

Monterey County Master Fee Resolution. SART staff and oversight committee Chair Chief Lawson

met with the Police Chiefs and they have taken a position of support.

FINANCING:

The recommended fee adjustment is intended to assist in recapturing, but not exceeding the County's

reasonable costs associated with the provision of SART examination and court testimony services

pursuant to Penal Code section 13823.95, and do not actually meet or exceed actual costs for

providing these services. Anticipated revenues resulting from proposed fee adjustment are included in

the FY 2011-12 Recommended Budget. The proposed fee assures a more accurate allocation of the

costs of the program to those entities that use the service, without requiring a subsidy from the County

General Fund.
