RECOMMENDATION:
It is recommended that the Board of Supervisors:
 
Approve and the authorize the Chair of the Board to execute the Road Maintenance Agreement with California American Water Company, in compliance with Condition of Approval No. 20 of Development Permit (PLN110373), for the Carmel River Reroute and San Clemente Dam Removal Project.
 
SUMMARY/ DISCUSSION:
On May 8, 2013, the Monterey County Planning Commission approved a Development Permit (PLN110373) to remove the San Clemente Dam on California American Water Company (CAWC) property, located at the confluence of Carmel River (River milepost 18.5) and San Clemente creek, Greater Monterey Peninsula and Cachagua area plan.
 
To address impacts to the transportation system, the Conditions of Approvals and Mitigations Measures for this project included an Encroachment (Condition No. 17), Road Maintenance Agreement (Condition No. 20) and Traffic and Circulation (Condition No. 38, Mitigation Measure).  Condition of Approval No. 17 requires the applicant to obtain an encroachment permit from the RMA- Public Works to construct road improvements. The design and construction is subject to the approval of the Public Works Director. Condition of Approval No. 20 requires the applicant to enter into a Road Maintenance Agreement, which shall include an annual maintenance schedule, specific maintenance measures, mitigate wear and tear of the paved portion of the hauling route (Carmel Valley Road) and any other improvements necessary for the paved portion of the hauling route. Condition No. 38, Mitigation Measure requires the applicant to restore affected public roads to pre-project condition immediately after construction is completed.  RMA-Public Works determined that the best method of achieving the condition requirement of restoring the affected roads to pre-project condition is for CAWC to improve Carmel Valley Road between Ford Road and Project Access (Ford Road segment) at the outset.  The work will occur between August 1, 2014 and October 1, 2014.  
 
The necessary improvements for the Ford Road Segment include (a) grind failed pavement areas to a minimum depth of 3" and pave back with hot mix asphalt (HMA) to match adjacent surfaces (prior to performing the work, the parties shall agree on the failed pavement areas to be repaired based on the recommendations of a third party professional engineer mutually selected by the parties who are experienced in the field of pavement engineering); (b) overlay the Ford Road Segment with 3" of ¾" HMA along with fiberglass mesh pavement fabric; (c) place shoulder backing as needed and provide thermoplastic striping and marking; and (d) install raised pavement markers to match existing markers, all in accordance with Caltrans Standard Specifications (Ford Road Segment Improvements) as agreed in Road Maintenance Agreement between County (RMA-Public Works) and CAWC.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, and Risk Management, have reviewed and approved the Road Maintenance Agreement as to form and legality, and insurance provisions, respectively.
 
FINANCING:
There is no financial impact to the General Fund.  All associated costs to implement the Road Maintenance Agreement will be borne by California American Water Company.
