RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.      Approve a Professional Services Agreement with AMEC Environment & Infrastructure, Inc. where the Base Budget is $161,336 and the Contingency budget is $16,134, for a total amount not to exceed $177,470 to provide an Environmental Impact Report (EIR) for the Carmel Canine Sports Center (PLN130352) in Carmel Valley, for a term of August 4, 2014 through May 27, 2015; and
b.      Approve a Funding Agreement with Carmel Canine Sports Center, LLC where the Base Budget is $161,336, the Contingency budget is $16,134, and the County contract administration fee is $3,170, for a total amount not to exceed $180,640 to allow funding to Monterey County for costs incurred by AMEC Environment & Infrastructure, Inc. and County departments to provide an EIR for the Carmel Canine Sports Center (PLN130352) in Carmel Valley, for a term of August 4, 2014 through May 27, 2015; and

SUMMARY/DISCUSSION:
This Professional Services Agreement (PSA) with AMEC Environment & Infrastructure, Inc. and related Funding Agreement (FA) with Carmel Canine Sports, LLC will provide an EIR for the Carmel Canine Sports Center.  The term of this PSA and FA is from August 4, 2014 through May 27, 2015.   
 
The costs for this PSA are to be covered through the FA with Carmel Canine Sports Center, LLC, Project Applicant, and are related to the completion of the Carmel Canine Sports Center EIR.  The FA also covers the County's contract administration fee associated with processing of the PSA and FA.  
 
This project is slightly unusual because an application for a Use Permit has been received, an Initial Study has been prepared, and a Mitigated Negative Declaration has been circulated for public review.  The result of these efforts have indicated that an EIR should be prepared, and this PSA and FA will move that effort forward.  Since the Project Applicant has paid fees for purposes of staff time spent processing the application, the conversion to the extraordinary project does not require payment of the normal deposit because a great deal of work on the application has already been accomplished.  The FA takes this into account requiring a $10,000 deposit upon approval of the FA, and additional deposits (in the amount of $10,000) will be collected when the deposit reaches a balance of $2,000.

FINANCING:
There is no impact to the General Fund as a result of these actions.  Pursuant to the terms of the FA with Carmel Canine Sports Center, LLC, Project Applicant, and the County, the expenses of AMEC Environment & Infrastructure, Inc. to provide an EIR for the Carmel Canine Sports Center and fees associated with County contract administration will be funded through budgets established in the FA.  Separate fees for County staff costs associated with the Project will be paid by the Project Applicant in accordance with the County of Monterey Land Use Fee Schedule.
