Title: a. RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.  Authorize the Agricultural Commissioner to execute, on behalf of the County of Monterey, a Standard Agreement and any Amendments thereto, with the Department of Pesticide Regulation (DPR) to perform work under the Enforcement Evaluation and Improvement Project not to exceed $60,641.24 each year for a period of three years ending June 30, 2017, and;
b.  Approve and authorize the Agricultural Commissioner, or his designee, to sign up to three (3) amendments to the agreement where the total amendment does not exceed twenty percent (20%) of the agreement and does not significantly change the scope of work.
 
SUMMARY/DISCUSSION:
The State of California routinely contracts with the Agricultural Commissioner to provide specific services.  Estimated revenue from the Agreement is included in the department's annual budget, as well as the appropriations associated with each activity.  
 
The Agricultural Commissioner requests authorization to enter into the proposed State Standard Agreement (Attachment I) for a period of three (3) years starting on April 1, 2015 (or upon final approval whichever occurs later) and ending June 30, 2017.
 
Activities under this agreement involve the collection and submission of historical pesticide use compliance and enforcement data.  DPR will evaluate these data and consult with the Agricultural Commissioner to determine if the enforcement responses are consistent and appropriate.  In addition, the data will highlight chronic violators and allow DPR to pursue statewide enforcement actions against individuals and businesses licensed by the State.
 
OTHER AGENCY INVOLVEMENT:
The County Administrative Office supports this action.  The Office of the County Counsel has approved the proposed Agreement as to form and legality.
 
 
FINANCING:
Revenues and appropriations for the Agreement are included in the FY 2014-15 Adopted Budget.
