a. Approve Budget Amendment No. 4 for the Water Resources Agency authorizing the Auditor-Controller to amend the Monterey County Water Resources Agency's FY 2014-15 Budget to pay additional costs associated with the Don Chapin arbitration and to cover property tax fees;
b. Amend the FY 2014-15 WRA Adopted Budget, Dept. 9300, Unit 8267, Fund 134 Salinas River Diversion Facility, Appropriation Unit WRA028, Account 6613, to increase appropriations by $454,636 (4/5th vote required);
c. Amend the FY 2014-15 WRA Adopted Budget, Dept. 9300, Unit 8267, Fund 134 Salinas River Diversion Facility, Appropriation Unit WRA028, Account 5750, to increase revenue by $454,636 (4/5th vote required); and
d. Amend the FY 2014-15 WRA Adopted Budget, Dept. 9300, Unit 8267, Fund 126 Zone 15 Carnation Subdivision, Appropriation unit WRA 016, Account 6613, to increase appropriations and estimated revenue by $62.00 financed by unassigned fund balance. (4/5th vote required)

RECOMMENDATION:
It is recommended that the Monterey County Water Resources Agency Board of Supervisors:
a. Approve Budget Amendment No. 4 for the Water Resources Agency authorizing the Auditor-Controller to amend the Monterey County Water Resources Agency's FY 2014-15 Budget to pay additional costs associated with the Don Chapin arbitration and to cover property tax fees.
b. Amend the FY 2014-15 WRA Adopted Budget, Dept. 9300, Unit 8267, Fund 134 Salinas River Diversion Facility, Appropriation Unit WRA028, Account 6613, to increase appropriations by $454,636 (4/5th vote required);
c. Amend the FY 2014-15 WRA Adopted Budget, Dept. 9300, Unit 8267, Fund 134 Salinas River Diversion Facility, Appropriation Unit WRA028, Account 5750, to increase revenue by $454,636 (4/5th vote required); and,
d. Amend the FY 2014-15 WRA Adopted Budget, Dept. 9300, Unit 8267, Fund 126 Zone 15 Carnation Subdivision, Appropriation unit WRA 016, Account 6613, to increase appropriations and estimated revenue by $62.00 financed by unassigned fund balance (4/5th vote required).
SUMMARY/DISCUSSION:
In October of 2014, the Water Resources Agency received an unexpected amount of $864,273 from the Monterey Regional Pollution Control Agency (MRWPCA) for the payment of outstanding water delivery/service invoices and reconciled FY 2013-14 Budget seed allocations with MRWPCA in the amount of $335,000 which was booked in FY 2014-15. In addition, the Agency agreed to binding arbitration in the Don Chapin case which required an additional payment of $119,636 from Fund 134. The last transaction for $62.00 is needed to cover property tax fees.

FINANCING:
The receipt of $864,273 in Fund 134 the Salinas River Diversion Facility (SRDF) from MRWPCA offsets the expenditures of $335,000 for FY 2013 14 reconciliation of seed allocation and the Don Chapin arbitration. Fund 126 has sufficient funds in its budget to appropriate $62.00 to pay for property tax fees.
