Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Chief Probation Officer to sign the Service Agreement with Transitions for Recovery and Re-entry Program, Incorporated to provide a short term reentry program implementing life-skills workshops, and cognitive behavior intervention strategies for AB 109 Public Safety Realignment eligible clients in an amount not to exceed $169,800 for the period July 1, 2015 to June 30, 2016; and

 

b. Authorize the Chief Probation Officer to sign up to three (3) future amendments to this Agreement where the amendments do not exceed ten percent (10%) of the original contract amount ($16,980) and do not significantly change the scope of work.

 

SUMMARY:

The AB109 Public Safety Realignment allocates funding to counties for mandates related to adult offenders that have been realigned from the State to local jurisdictions. The Probation Department serves as lead agency and fiscal agent for the implementation of the AB109 Public Safety Realignment plan. Funding is allocated for custody supervision and treatment services. Transitions for Recovery and Re-entry Program, Incorporated (Transition for Recovery) will provide a structured Cognitive Behavioral 30-day program.

 

DISCUSSION:

The Public Safety Realignment plan for Monterey County was developed by the local Community Corrections Partnership (CCP) and approved by its Executive Committee and Monterey County Board of Supervisors. The Probation Department is responsible for implementation and financial oversight of the AB109 Public Safety Realignment plan, distributing a total of $12,855,898 for Fiscal Year (FY) 2015-16 to local organizations and county agencies supporting the AB 109 Public Safety Realignment community programs in Monterey County.

 

Transitions for Recovery has been allocated funding in the amount of $169,800 to provide a structured Cognitive Behavioral 30-day program for adult offenders eligible for the program. Transitions for Recovery is a non-profit agency. The agency will provide a curriculum that includes the use of the cognitive behavioral approach in order to teach participants a range of life-skills such as anger management, healthy relationships, and substance abuse relapse prevention upon release from incarceration or as an intermediate sanction for those offenders who need increased supervision and accountability. Services will be available in the following locations: Salinas, Monterey Peninsula, and South County.

 

It is acknowledged that this contract guarantees payment for a minimum number of spaces at the Monterey and South County locations, regardless of the actual number of participants attending at those sites.  This issue was raised before the CCP at the February, 2015 meeting, but staff was directed to further negotiate the issue with Transitions for Recovery.  This agreement represents the greatest concession staff was able to obtain from the vendor.

 

OTHER AGENCY INVOLVEMENT:

The agreement has been approved by County Counsel as to legal form and by the Auditor-Controller as to fiscal terms. 

 

FINANCING:

Funds associated with this recommendation in the amount of $169,800 are allocated by the State for AB 109 Public Safety Realignment. Funding for all AB 109 programs has been authorized in the current state budget and is included in Probation’s budget unit 8165 for FY 2015-16. There is no additional cost to the County General Fund associated with this recommendation.
