b. Authorize the County Administrative Office and the Auditor-Controller to incorporate the position change into the FY 2015-16 Adopted Budget.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Amend Personnel Policies and Practices Resolution No. 98-394 to Retitle Supervising District Attorney Investigator (34A80) to District Attorney Investigative Captain;
b. Authorize the County Administrative Office and the Auditor-Controller to incorporate the position change into the FY 2015-16 Adopted Budget.
SUMMARY:
The Supervising District Attorney Investigator (SDAI) at the Monterey County District Attorney’s Office is a safety management position above the rank of Police Lieutenant and/or Sheriff Commander. The SDAI often performs the duties of higher level safety management, or that of a Captain and Assistant Chief, commensurate with the responsibilities within other District Attorney offices throughout the state. The Monterey County SDAI position has historically been misunderstood by law enforcement agencies and peace officers and their associations in general. The dilemma, and perhaps the reason for the confusion, derives from the reasoning adopted by the Peace Officer Standard and Training (POST). POST interprets the title of “supervisor” and/or a title including “supervising” as a first line supervisor or sergeant equivalent; mainly, because of the law enforcement hierarchy postured throughout the other 58 Counties in the State of California have many layers in rank, i.e., Sheriff, Undersheriff, Chief, Deputy Chief, Assistant Chief, Captain, Commander, Lieutenant, Sergeant/Supervisor, and Corporal.
DISCUSSION:
Since our SDAI is a safety management position above the rank of Police Lieutenant/Sheriff Commander, POST requires any rank above lieutenant to attend the POST management school within the first year of employment. Our office adheres to this POST requirement and sends our SDAIs to this training. Our problem arises when we request a POST Management Certificate for our SDAIs, POST denies the request because at quick glance the SDAI title does not match that of a management position of lieutenant or above.
It is therefore recommended that the Board change the title of the Supervising District Attorney Investigator Classification (34A80), to “District Attorney Investigative Captain (34A80)”. There are no changes to the duties and responsibilities under the new title of “Captain” and the position will continue to complete those safety management duties in conjunction with the Chief District Attorney Investigator.

FINANCING:
There will be no new net county cost to the County General Fund.
