b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 3 to the Professional Services Agreement and future amendments to this Agreement where the amendment does not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 3 to Professional Services Agreement MYA#3000*315 with Creegan + D’Angelo Engineers to continue to provide on-call design engineering, architecture and technical services (RFQ #10249), in the amount of $75,000 for a total amount not to exceed $175,000, and extend the term to February 28, 2017; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 3 to the Professional Services Agreement and future amendments to this Agreement where the amendment does not significantly alter the scope of work or change the approved Agreement amount.
SUMMARY/DISCUSSION:
On March 9, 2012, the Contracts/Purchasing Officer executed a Professional Services Agreement (PSA) with Creegan + D’Angelo Engineers (C+D) (Multi-Year Agreement (MYA) #3000*315) in the amount of $100,000 to provide on-call design engineering, architecture and technical services for the Resource Management Agency -Public Works (RMA-PW) (Request for Qualifications (RFQ) #10249) for a term from February 28, 2012 to February 28, 2014. Thus far C+D’s PSA term has been extended twice. Attachment A provides a summary of amendments to the PSA.
Under that PSA, C+D have provided engineering services for various projects for RMA-PW; such as Youth Camp Demolition, Big Sur Emergency Watershed Protection Program, and Las Lomas Drainage.
Currently C+D is providing engineering services for the Las Lomas Drainage project. The purpose of the project is to construct underground drainage facilities on Las Lomas Drive, from Hall Road to Thomas Road, in the Community of Las Lomas. Due to unforeseen sewer utility conflicts with the underground storm drain design, it is required to modify C+D’s scope to include tasks that will address and resolve the utility conflicts.
Amendment No. 3 to the PSA will increase the amount by $75,000 for a total amount not to exceed $175,000 and extend the term to February 28, 2017; ultimately allowing the addition of tasks to C+D’s scope for the Las Lomas Drainage project.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller Office have reviewed and approved Amendment No. 3 as to form and legality, and fiscal provisions, respectively.
FINANCING:
There is no additional impact to the General Fund as services provided by C+D will be reimbursed as part of the FY 2015-16 Board approved and appropriated project budgets.
The Las Lomas Drainage project was initially allocated $1,000,000 from Fund 404. At that time, the project had an estimated cost of $925,000 that included environmental, engineering, and construction. There are sufficient funds in the project to fund the $75,000 increase in project cost to the allocated allocation by the Board. There are sufficient appropriations in FY 2015-16 (Fund 002, SubFund HORC, Unit 8195, Appropriation RMA012) to finance the project.
