RECOMMENDATION:
It is recommended that the Monterey County Parks Commission:
Provide approval to the Director of Parks and Recreation to designate Toro Regional Park, Jacks Peak Park, Royal Oaks Park, and Manzanita Park as nonsmoking parks.

SUMMARY/DISCUSSION:
During the public hearings that were held by the Parks Commission regarding the Monterey County Parks Department Strategic Plan, comments were submitted by the Monterey County Health Department asking the Parks Commission and Parks Department consider designating county parks nonsmoking. In response to this request, the Parks Department seeks the Parks Commission's approval to move forward in designating day-use parks as nonsmoking.

In 1994, County Ordinance 10.70.050 was passed stating that smoking shall be prohibited in all public places within the unincorporated areas of Monterey County, including, but not limited to, the following places; Item Q: "Parks, outdoor recreation areas, and recreational trails, where such parks, recreation areas, and trails are designated as nonsmoking". Additionally in 1994, County Ordinance 10.70.080 was passed stating that "any owner, operator, manager, or other person who controls any establishment described in this Chapter may declare that entire establishment as a nonsmoking establishment". Furthermore, County Ordinance 14.12.130.A.7 gives the Parks Department express authority to prohibit smoking in fire hazards.

It is under Ordinance 10.70.080 and 14.12.130.A.7 that the Director of Parks & Recreation asks for the Parks Commission's approval to designate the county day use parks as nonsmoking to include: Toro Regional Park, Jacks Peak Park, Royal Oaks Park, and Manzanita Park.
