RECOMMENDATION:

It is recommended that the Board of Supervisors:

 

a. Adopt the Monterey County 2015 Construction Task Catalog, JOC 2015-Roads & Bridges Project Specifications and JOC 2015-Facilities Project Specifications, and Monterey County 2015 Technical Specifications for the Job Order Contracting 2015, Project No. JOC 2015, Bid No. Roads & Bridges 2015-01, Bid No. Roads & Bridges 2015-02, and Bid No. Roads & Bridges 2015-03, and Project No. JOC 2015, Bid No. Facilities 2015-01, Bid No. Facilities 2015-02, and Bid No. Facilities 2015-03; and

 

b. Authorize the Director of Public Works to advertise for bids in the Monterey County Weekly.

 

SUMMARY:

The recommended action allows for the adoption of the 2015 Monterey County Job Order Contracting (JOC) Task Catalogs for the JOC 2015 contracts and advertising for bids.

 

DISCUSSION:

Public Contract Code Section 20128.5 provides that counties may award annual contracts for repair, remodeling, or other repetitive work to be done according to unit prices, commonly referred to as Job Order Contracting (JOC).

 

On April 9, 2013, the Board of Supervisors approved an Agreement between the County of Monterey and The Gordian Group, Inc. to provide the County with than a JOC System.  The Gordian Group JOC system uses an extensive catalog of construction tasks and associated technical specifications containing over 260,000 individual items specifically designed for Monterey County.  Each awarded contract has a maximum amount of $4,590,340, with $25,000 worth of work guaranteed over its one-year term.

 

Since inception, the JOC program has proven valuable to Resource Management Agency -Public Works (RMA-PW) by improving economy and efficiency in completing a number of public works projects, including urgent and time-sensitive projects.  In light of the many capital projects slated for Fiscal Years (FYs) 2015-16 and 2016-17, it is recommended that three Roads & Bridges and three Facilities Job Order Contracts be issued each for $4,590,340 with $25,000 worth of work guaranteed in each contract.  Each contract would be awarded to three separate contractors to allow RMA-PW the option to use alternate contractors if one contractor is deemed nonresponsive or has poor performance.  Any Job Order that would exceed $1 Million will be brought to the Capital Improvement Committee (CIC) and Budget Committee (BC) prior to issuing the Notice to Proceed.  The contracts will apply to projects listed in FYs 15-16 and 16-17 Adopted Capital Budgets, equipment installation, and facilities maintenance repair projects.  The JOC contracts will not exceed beyond a 12-month contract for issuing of job orders.  Any capital and/or facilities maintenance repair project that enters into the following fiscal year will be budgeted.  RMA-PW will continue to provide quarterly JOC status reports to the CIC which would include scope, cost, schedule, source of previously appropriated/ expended funds, and contractor evaluations.

 

A “Notice to Bidders” will be duly advertised in a newspaper of general circulation per Public Contracts Code Sec 20150.8.  JOC 2015 contracts are anticipated to be awarded in November 2015.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel, Auditor-Controller, and Risk Management have reviewed and approved the Project Specifications as to form and legality, fiscal terms, and insurance provisions, respectively.

 

FINANCING:

There is no additional impact to the General Fund.  The JOC 2015 contracts are for six individual Job Order Contracts each with a cap of $4,590,340 for a total of $27,542,040.  Expenditures will be within and not exceed the FYs 2015-16 or 2016-17 Adopted Budgets.  A five percent (5%) License Fee to utilize the JOC program is payable to the Gordian Group only if and when a Job Order is issued to a JOC Contractor.  Optionally, as needed, the County may utilize JOC Project Management services for an additional 5.95% fee.
