a. Ratify, amend, and authorize the Contracts/Purchasing Officer or his designee to execute a contract between Foray Incorporated and the County of Monterey started on March 9, 2015 in the amount of $6,500; and
b. Authorize the Contracts/Purchasing Officer or his designee to approve up to three future amendments to this Agreement where the combined total of all amendments do not exceed $20,000 (for a combined contract total of not exceed $26,500) and do not significantly change the scope of work.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Ratify, amend, and authorize the Contracts/Purchasing Officer or his designee to execute a contract between Foray Incorporated and the County of Monterey started on March 9, 2015 in the amount of $6,500; and
b. Authorize the Contracts/Purchasing Officer or his designee to approve up to three future amendments to this Agreement where the combined total of all amendments do not exceed $20,000 (for a combined contract total of not exceed $26,500) and do not significantly change the scope of work.
SUMMARY/DISCUSSION:
The Monterey County Sheriff’s Department engaged the services of Foray, Incorporated to provide software support and updates used in the Crime Laboratory for a system that can verify the integrity of incoming photographic data, and evaluate if the pixels in the photos have been altered. If the photo becomes altered, it time and date stamps all changes, producing an audit trail. This is an important function within for the Crime Laboratory that uses incoming photographs from external sources to identify inmates and to create case files used in prosecution.
The software support contract was renegotiated and signed by the vendor prior to the expiration date of March 8, 2015 but protracted negotiations to secure insurance meeting County standards delayed the routing of this contract. A contract was not fully executed and signed until June 3, 2015, and was not received back at the department until June 7, 2015, and the department must now ratify this contract retroactive to March 9, 2015.
OTHER AGENCY INVOLVEMENT:
County Counsel, County Information Technology, the Auditor-Controller and Contracts/Purchasing have reviewed their respective portions of this contract. Approval by Risk was not needed because vendor was converted to a standard County contract, and secured County-required levels of insurance.
FINANCING:
There will be no increase in the General Fund Contribution as a result of this board action. Funding for the support services is included in the Sheriff’s FY 2015-16 Adopted Budget.
