Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Ratify, approve and authorize the Director of Health or Assistant Director of Health to sign an Agreement with Wolters Kluwer Health, UpToDate, Inc. to provide an UpToDate Anywhere Electronic Clinical Resource Subscription, for a total contract amount not to exceed $18,960.00, for the period of November 1, 2015 to October 31, 2016; and

b.                     Accept the recommendations of the Director of Health regarding modifications to the insurance provisions in the Agreement; and

c.                     Authorize the Director of Health or Assistant Director of Health to sign up to three (3) future amendments to this Agreement where the amendments do not exceed 10% of the original contract amount ($1,896.00) and do not significantly change the scope of work.

 

SUMMARY/DISCUSSION:

Wolters Kluwer Health, UpToDate, Inc. (UpToDate)  is the leading web based clinical research tool utilized in clinic to obtain answers to clinical questions, including the latest evidence, and provides for specific, practical recommendations for diagnosis and treatment.

 

Approval of the recommended action will provide Health Department Clinic Services physicians and mid-levels continued access to this valuable resource tool in providing current and up to date medical information and resources at the point of patient care.  Included in this contract, at no additional cost, is the functionality of UpToDate Anywhere.  This enhancement will allow for physician and mid-level access to UpToDate from any internet-enabled device including desktop computers, laptops, and mobile devices.

 

Since 2007, the Health Department has contracted with UpToDate utilizing UpToDate’s Agreement. For this renewal, UpToDate has agreed to sign the County’s Standard Agreement with modification to the insurance requirements.  Risk has reviewed and cannot approve the deletion of Section 9.04.  The Contractor has provided proof of commercial general liability and automobile liability but cannot provide the contract required additional insured and primary and non-contributory endorsements.  The Health Department recommends moving forward as this is an internet based subscription service that will not require on-site training or assistance.  Since the current contract expires October 31, 2015, to ensure continuity of service, UpToDate is providing continued web access to the site until the contract is fully executed.

While this work is not directly in support of a Health Department strategic initiative, it is in support of one or more of the ten essential public health services, specifically to inform, educate, and empower people about health issues.

 

OTHER AGENCY INVOLVEMENT:

County Counsel, the Auditor-Controller and Contracts/Purchasing have reviewed and approved the Agreement. Risk Management has reviewed and cannot approve the deletion of the County standard insurance requirement.  This Agreement is on file with the Clerk of the Board.

 

FINANCING:

Sufficient funds are available in the Clinic Services Bureau, Health Department FY2015-16 Adopted Budget 4000-HEA007.  There is no financial impact to the General Fund resulting from approval of this Agreement.
