a. Approve and authorize the Director of the Department of Social Services to sign an agreement with the Monterey County Office of Education (MCOE), the Salinas City Elementary School District, and iResult for confidential data exchange, effective upon signature by all parties through June 30, 2017;
b. Authorize the Director of the Department of Social Services to sign identical agreements with Monterey County School Districts that would wish to participate in the confidential data exchange in the future; and
c. Authorize the Director of the Department of Social Services to sign up to (3) amendments to these agreement where the scope of work is not significantly changed.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of the Department of Social Services to sign an agreement with the Monterey County Office of Education (MCOE), the Salinas City Elementary School District, and iResult for confidential data exchange, effective upon signature by all parties through June 30, 2017; and
b. Authorize the Director of the Department of Social Services to sign identical agreements with Monterey County School Districts that would wish to participate in the confidential data exchange in the future; and
c. Authorize the Director of the Department of Social Services to sign up to (3) amendments to these agreement where the scope of work is not significantly changed.
SUMMARY/DISCUSSION:
The Salinas City Elementary School District is a local educational authority authorized to maintain student records subject to the Family Educational Rights and Privacy Act (FERPA) and the Education Code. The Department of Social Services is a county placing agency under Education Code Section 49061, subdivision (f). MCOE is the current provider of Foster Youth Services and is accessing Title IV-E Administrative funding to serve this population. iResult assists school districts and community partners by collecting data from educationally based support services, such as after-school programs, college readiness programs, mentoring, student advocacy groups, as well as educational and testing data. iResult collects and provides access to data so that the District can measure the impact of their programs in terms of student results.
MCOE, the Department of Social Services, and iResult desire to use data from the District’s student records (referred to as “Confidential Information”), including personally identifiable information from student records. MCOE, the Department of Social Services, and iResult will use the Confidential Information in order to ensure the accuracy and effectiveness of educational services for youth residing in Foster Care. Data will be used to enhance existing efforts to support educational outcomes for youth in out-of-home care. This will also support efforts to meet the goals of the California Child & Family Services Review, as required under Federal and State law.
The Department of Social Services is collaborating with the Salinas City Elementary School District, as well as other Monterey County School Districts, M.C.O.E. and iResult to more effectively manage educational records for children in foster care and to analyze student performance. The purpose of sharing confidential information is to carry out an evaluation of the District’s federal and/or state supported education programs. Information will be used to evaluate how foster students are performing at the District’s schools, and the effectiveness of the District’s secondary educational programs for foster youth.
OTHER AGENCY INVOLVEMENT:
Purchasing has reviewed and approved this agreement. County Counsel has approved the agreement as to form.
FINANCING:
This is a no cost agreement for sharing of confidential information. Approval of this action has no impact on the County General Fund contributions.
