Adopt a Resolution approving Property Tax Transfer for the Proposed “Spreckels Fire Protection Reorganization” including:

a.  Divestiture if fire protection service currently provided by the Spreckels Community Services District; and

b.  Annexation to the Monterey County Regional Fire Protection District.

RECOMMENDATION:

It is recommended that the Board of Supervisors adopt a resolution approving a Property Tax Transfer for the Proposed “Spreckels Fire Protection Reorganization” including:

a.   Divestiture if fire protection service currently provided by the Spreckels Community Services District; and

b.  Annexation to the Monterey County Regional Fire Protection District.

 

SUMMARY:

The Local Agency Formation Commission (LAFCO) of Monterey County is in receipt of a reorganization proposal involving provision of fire protection and emergency medical services to the community of Spreckels.  This involves annexation of all Spreckels area lands not currently within the fire district (approximately 200 acres) and divestiture of fire protection services provided by the Spreckels Community Services District.  The two district boards have jointly initiated and are in support of the proposed reorganization.  The proposal cannot be considered by LAFCO until a property tax transfer has been approved.

 

DISCUSSION:

The Board of Supervisors has adopted a tax transfer formula, which states that fire protection districts would be allocated a portion of County tax increment.  The formula has been revised to reflect the County’s loss of property tax revenue that was imposed by the State during fiscal year 1993-94.  Non-affected jurisdictions would retain their percentage share of property taxes collected within an affected code area.  The Monterey Regional Fire Protection District and the County would share the amount of property tax increment available for distribution based on their current ratio in a typical tax rate area. 

 

The processing of this action does not affect or expand any existing 201 rights (i.e., the right of a fire department who provided a level of EMS service to continue to provide such service; Health and Safety Code Section 1797.201) of any party to the annexation that may or may not exist at this time.

 

OTHER AGENCY INVOLVEMENT:

The Monterey Regional Fire Protection District Board will consider this property tax transfer action on November 17, 2015.  The attached resolution was previously approved as to form by County Counsel.

 

FINANCING:

The annexation proposal territory is located in six tax rate areas as described in the attached resolution.  At the completion of the annexation process, the County of Monterey and Monterey Regional Fire Protection District will receive percentages of property tax increment as shown below:
