b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 6 to Professional Services Agreement No. A-11433 and future amendments that do not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 6 to Professional Services Agreement No. A-11433 with Biggs Cardosa Associates, Inc. to include construction support services for the Peach Tree Road Bridge Replacement at Pancho Rico Creek, County Bridge No. 412, County Project No. 220165, Federal Aid Project No. STPLZ-5944 (041), in the amount of $74,300 for a total amount not to exceed $405,213, and extend the term to February 28, 2017; and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 6 to Professional Services Agreement No. A-11433 and future amendments that do not significantly alter the scope of work or change the approved Agreement amount.
SUMMARY/DISCUSSION:
The County of Monterey, Resource Management Agency (RMA) - Public Works has identified a need for Biggs Cardosa Associates, Inc. (BCA) to add design support services during construction to the original scope of the Professional Services Agreement (PSA) for the Peach Tree Road Bridge Replacement at Pancho Rico Creek, County Bridge No. 412, County Project No. 220165, Federal Aid Project No. STPLZ-5944 (041) (hereinafter, “Project”). BCA completed final design of the Project in December of 2015.
Amendment No. 6 to PSA No. A-11433 provides for the inclusion of design support services during construction for the Project. The design support services require the design engineers to be available in case questions arise during construction. Amendment No. 6 will increase the PSA by $74,300, for a total amount not to exceed $405,213, and extend the term of the PSA to February 28, 2017.
Attachment A provides a summary of the PSA to date.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller Office have reviewed and approved Amendment No. 6 as to form and legality, and fiscal provisions, respectively.
FINANCING:
There is no impact to the General Fund. The total estimated project cost, including project management, engineering, utility relocation and construction is $2,810,610, which will be funded by Federal Highway Administration (FHWA) funds and State Seismic Fund. Additional funding from a variety of Federal, State and local revenue has been authorized for design, environmental, right-of-way and construction of the project. Due to the unanticipated increased costs related to the right-of-way acquisitions, the project is currently unfunded in the amount of $34,021 which may impact the Road Fund (Fund 002, Unit 8195). However, these costs are eligible for reimbursement under the Highway Bridge Program (HRP). Staff will request reimbursement from CalTrans for the additional costs. Sufficient appropriations are available in the RMA - Public Works Budget (Fund 002, Unit 8195) to finance Amendment No. 6.
