RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and authorize the Director of Health or Assistant Director of Health to execute Amendment No. 1 to the Agreement between the County of Monterey and Mercy Air Service, Inc. the Agreement is set to expire on May 16, 2016.  The Director of Health seeks approval of a one-year (1) extension to ensure the continuity of the critical EMS Aircraft services provided by Mercy Air Service, Inc. for the term of May 16, 2016 through May 16, 2021, for the provision of Emergency Medical Services Aircraft services for the County of Monterey; and

b.                     Authorize the Director of Health or Assistant Director of Health to sign up to three (3) amendments to the Agreement that do not significantly change the scope of work, to extend the term of the Agreement for a period up to five additional years.

 

SUMMARY:

The Director of Health seeks authorization to execute Amendment No. 1 to the Agreement between the County of Monterey and Mercy Air Service, Inc. for the provision of EMS Aircraft services for the County of Monterey and to authorize the Director of Health or designee to sign up to three (3) amendments to the Agreement that do not significantly change the scope of work, to extend the term of the Agreement for a period up to five additional years.

 

DISCUSSION:

Emergency Medical Services (EMS) Agency is designated under California law by Monterey County as the local Emergency Medical Services Agency responsible for planning, implementing, and evaluating the local EMS system throughout Monterey County.

 

Under California law, no person or organization may provide "advanced life support," also known as "paramedic" services, unless that person or organization is an authorized part of the emergency medical services system of the local EMS agency.

 

Under California law, a paramedic service provider, including EMS aircraft services, must have a written agreement with the local EMS agency to participate in the EMS system and to comply with all applicable state regulations and local policies and procedures, including participation in the local EMS agency's continuous quality improvement ("CQI") program.

 

On May 15, 2012, the Board of Supervisors approved and authorized the Emergency Medical Services (EMS) Agency Director to sign and execute an EMS Aircraft Service Provider Agreement with Mercy Air Service, Inc. to provide EMS Aircraft services to the County of Monterey. The Agreement is set to expire on May 16, 2016.  The Director of Health seeks approval of a one-year (1) extension to ensure the continuity of the critical EMS Aircraft services provided by Mercy Air Service, Inc. and to authorize the Director of Health or designee to sign up to three (3) amendments to the Agreement that do not significantly change the scope of work, to extend the term of the Agreement for a period up to five additional years.

 

While this work is not directly in support of a Health Department strategic initiative, it is in support of one or more of the ten essential public health services, specifically: (6) Enforce laws and regulations that protect health and ensure safety and (7) link people to needed personal health services and assure the provision of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel has reviewed proposed Amendment No. 1 as to form and legality

 

FINANCING:

There is no General Fund Contribution resulting from this Board action.
