Title

Approve and adopt a Resolution amending Article VII of the Master Fee Resolution to set fees and authorize collection of fees by the Sheriff’s Office effective August 1, 2016, as set forth in the attached in Exhibit A.

 

Report

RECOMMENDATION:

It is recommended the Board of Supervisors approve and adopt a Resolution amending Article VII of the Master Fee Resolution to set fees and authorize collection of fees by the Sheriff’s Office effective August 1, 2016,  as set forth in the attached in Exhibit A.

 

SUMMARY:

The Monterey County Code Section 1.40.010 of Chapter 1.40 provides that all fees, penalties, refunds, reimbursements, and charges of any kind by the County shall be specified in the Monterey County Fee Resolution. Article VII reflects the authorized fees of the Monterey County Sheriff’s Office (MCSO). The MCSO is submitting for approval of fee changes driven by cost of living adjustment (COLA) increases as well as contractual increases, administrative and service fees increases. All requests to modify individual fees in Article VII are calculated to recover no more than the actual and reasonable costs to render the identified services to the recipient/beneficiary of the services.

 

DISCUSSION:

Selected fee adjustments in Article VII are being submitted to the Board for approval based solely on increases in COLA and costs (salary & benefit, overhead cost, material and supplies, etc.) of providing the service or administratively processing the requested document, such as to issue permits, abate vehicles, create fingerprint cards, or conduct records checks. Such as increases on Section 1, Items A.1, D.4, L.1, L.4, L.5, L.6, S.1 and Section 3, Item C.1, C.4, C.5, and C.6 as well as decrease on Section 2, Item A.1 showing a requested increase or decrease due to salary and benefit increases and changes in the time increment needed to check all data sources necessary to complete paperwork involved in releasing a vehicle stored by order of MCSO.

 

Section 3, Item C.5 shows adjustments made to reflect increases in providing private autopsies conducted pursuant to the Government Code Section 27520 due to increases in protective clothing and linens to perform an autopsy as it requires wearing proactive clothing, which the cost is added straightly into the total cost of performing such tasks.

 

The calculations and documents in support of all fee adjustments recommended herein are on file with the Clerk of the Board and are attached to this report. In all cases, the proposed fees reflect no more than the actual, reasonable, fully loaded costs of the services provided to the payor/applicant. Some fees can be waived for those meeting particular criterion, and these fees are footnoted through Article VII. By definition, these service charges are not a “tax” and are exempt from voter approval pursuant to Article XIII C Section 1(e)(1)-(3) of the California Constitution (Prop. 26: charge imposed for specific benefit conferred/privileges/service or product/reasonable regulatory costs provided or granted to the payor.)

 

OTHER AGENCY INVOLVEMENT:

The County Counsel's Office has reviewed the report and has approved the fees as to form. The Auditor’s Office has been consulted regarding the calculation of the fees.

 

FINANCING:

There is no increase to the General Fund Contribution as a result of this recommendation; the adjustments reflect no more than the actual cost of providing the service as permitted by law.  The estimated revenues and expenditures are included in the Sheriff’s FY 2016-17 budget requests.
