a. Approve Amendment No. 6 to Professional Services Agreement No. A-12323 with Granite Rock Company dba FMG to continue to provide services associated with on-call rental of fully operated, fueled and maintained asphalt grinding and paver machines at various locations in the County and as directed by the County of Monterey, Resource Management Agency to: update the Price Lists; increase the not to exceed amount of $550,000 by $100,000 for a total amount not to exceed $650,000; and extend the expiration date from June 30, 2016 for an additional year through June 30, 2017, for a revised term from May 1, 2012 to June 30, 2017; and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 6 to Professional Services Agreement No. A-12323 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved amount of the Agreement.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a. SUMMARY:
The County has 1,100 miles of paved roads of which 99% are in need of some type of pavement rehabilitation. The Resource Management Agency (RMA) needs, but does not own and cannot rent, a bare, track-mounted cold planer or a 4’ wide asphalt paver. This very specialized equipment is not economic to own (cost is approximately $500,000 and annual use is of 4-6 weeks); therefore, this as-needed rental Professional Services Agreement (PSA) gives the RMA access to the most efficient equipment available without any capital investment. Granite Rock Company dba FMG’s large inventory of late-model, consistently reliable equipment and skilled operators have provided the RMA with maximum scheduling flexibility and excellent performance. The RMA has identified a continued need for Granite Rock Company dba FMG to provide on-call rental of fully operated, fueled and maintained asphalt grinding and paver machines at various locations in the County.
DISCUSSION:
This Amendment No. 6 will update the Price Lists; increase the not to exceed amount of $550,000 by $100,000 for a total amount not to exceed $650,000; extend the expiration date from June 30, 2016 for an additional year through June 30, 2017, for a revised term from May 1, 2012 to June 30, 2017 (beyond the anticipated five (5) year PSA term for a total term of five (5) years, two (2) months); and will enable the RMA to continue to repair the rapidly deteriorating County roads in a safe and cost-effective manner. This will be the last amendment without going out to bid for this service.
Attachment A provides a summary of the PSA to date.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller Office have reviewed and approved Amendment No. 6 as to form and legality, and fiscal provisions, respectively.
FINANCING:
The costs associated with Amendment No. 6 to this PSA will be funded by the Road Fund (Fund 002, Sub Fund RBMT, Unit 8443, Appropriation Unit RMA 012). Costs for equipment is included as part of the project costs that have been budgeted. Sufficient appropriations are available in the Fiscal Year 2016-17 budget to fund Amendment No. 6.
