RECOMMENDATIONS:

It is recommended that the Board of Supervisors:

 

a.  Approve Amendment No. 7 to Professional Services Agreement No. A-10741 with LSA Associates, Inc. to include support on regulatory permit acquisitions for the Davis Road Bridge Replacement and Road Widening Project at Salinas River, County Bridge No. 208, County Project No. 360065, Federal Aid Project No. BRLS-5944 (068) to increase the not to exceed amount of $830,795 by $40,700 for a total amount not to exceed $871,495 and extend the expiration date from June 30, 2016 for an additional year through June 30, 2017, for a revised term from September 1, 2006 to June 30, 2017; and

 

b.  Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 7 to Professional Services Agreement No. A-10741 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved amount of the Agreement.

 

SUMMARY/DISCUSSION:

The County of Monterey, Resource Management Agency (RMA) has identified a need for LSA Associates, Inc. (LSA) to include support on regulatory permit acquisitions to the original scope of the Professional Services Agreement (PSA) for the Davis Road Bridge Replacement and Road Widening Project at Salinas River, County Bridge No. 208, County Project No. 360065, Federal Aid Project No. BRLS-5944(068) (hereinafter, “Project”).  To date, LSA has completed approximately 95% of the environmental services of the PSA and the Environmental Impact Report (EIR)/Environmental Assessment (EA) for the Project is also scheduled for County Board of Supervisors approval in June 2016. 

 

Amendment No. 7 to PSA No. A-10741 provides for the inclusion of support on regulatory permit acquisitions for the Project.  Various regulatory permits, including: 1) Nationwide Permit for Section 404 of the Clean Water Act (CWA) from the United States Army Corps of Engineers (USACE), 2) Lake or Streambed Alteration Agreement for Section 1602 of the California Department of Fish and Game (CDFG) Code from the California Department of Fish and Wildlife (CDFW), and 3) Water Quality Certification for Section 401 of the CWA from the California Regional Water Quality Control Board (CRWQCB), are required in order to begin construction of the Project.  LSA will coordinate with the above named environmental regulatory agencies and will prepare permit applications for County approval and final submittal by LSA until final completion.  Amendment No. 7 will increase the not to exceed amount of $830,795 by $40,700 for a total amount not to exceed $871,495 and extend the expiration date from June 30, 2016 for an additional year through June 30, 2017, for a revised term from September 1, 2006 to June 30, 2017.

 

Attachment A provides a summary of the PSA to date.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel, Risk Management Office and Auditor-Controller Office have reviewed and approved Amendment No. 7 as to form and legality, and indemnity and insurance and fiscal provisions, respectively.

 

FINANCING:

The total estimated Project cost, including engineering, environmental, right-of-way and construction is $58,779,691.  The Project is currently unfunded in the amount of $4,088,512.    Currently all available funds are committed, so this could be a significant impact.  Staff is actively pursuing additional funding sources to fully fund the Project.  In the event that full funding is not obtained for the Project by the time final design has been completed, staff will analyze the option of phasing the construction of the Project.   Funding from a variety of Federal, State and local revenue has been authorized for the design and environmental portion of the Project.  There is no planned General Fund contribution for this project.  The total cost of Amendment No. 7 to the PSA is $40,700 for a total amount not to exceed $871,495.  Sufficient appropriations are available in the RMA - Public Works Budget (Fund 002, Subfund HORC, Unit 8195, RMA012) to finance Amendment No. 7.
