2. Adopting the Third Substantial Amendment to the FY 2015-16 Annual Action Plan to expand the scope of work for the City of Del Rey Oaks grant;
3. Adopting the First Substantial Amendment to the FY 2016-17 Annual Action Plan to expand the scope of work for the City of Greenfield’s Patriot Park project.
b. Adopt the Amended Citizen Participation Plan and the Substantial Amendments to the Annual Action Plans; and,
c. Authorize the Director of Economic Development to submit the Amended Citizen Participation Plan and the Substantial Amendments to the Annual Action Plans to the U.S. Department of Housing and Urban Development (HUD).

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Hold a Public Hearing on:
1) Amending the Citizen Participation Plan sections related to where future public notices regarding Substantial Amendments to Annual Action Plans of the Community Development Block Grant (CDBG) Urban County program are published;
2) Adopting the Third Substantial Amendment to the FY 2015-16 Annual Action Plan to expand the scope of work for the City of Del Rey Oaks ;
3) Adopting the First Substantial Amendment to the FY 2016-17 Annual Action Plan to expand the scope of work for the City of Greenfield’s Patriot Park project.
b. Adopt the Amended Citizen Participation Plan and the Substantial Amendments to the Annual Action Plans; and,
c. Authorize the Director of Economic Development to submit the Amended Citizen Participation Plan and the Substantial Amendments to the Annual Action Plans to the U.S. Department of Housing and Urban Development (HUD).
SUMMARY:
U.S. Department of Housing and Urban Development (HUD) regulations require the County to adopt a Five Year Consolidated Plan and Annual Action Plans to receive Community Development Block Grant (CDBG) Urban County funds. Appendix C is the County’s Citizen Participation Plan and describes how and where the County will publish notices related to the development and evaluation of the local CDBG program. The Annual Action Plans list approved projects and the amount of funding being made available to support each project. The Urban County is proposing to amend the Citizen Participation Plan to target public outreach to communities where projects are located; it also proposes to amend the prior and current year Action Plans to accommodate requests by the cities of Del Rey Oaks and Greenfield to change their funded projects.
DISCUSSION:
On June 8th, 9th, and 11th, 2016, a Notice of a 30-Day Public Comment Period was published in the following newspapers: Monterey County Weekly, Gonzales Tribune, Soledad Bee, Greenfield News and the King City Rustler, and El Sol newspapers in regard to: an Amendment to the Citizen Participation Portion of the Consolidated Plan; Adoption of the Third Substantial Amendment to the FY 2015-16 2016 Annual Action Plan; and Adoption of the First Substantial Amendment to the FY 2016-17 Annual Action Plan. The purpose of the Public Hearing is to consider amending the Citizen Participation public noticing requirements and to consider changes to projects that have previously been approved by the Board of Supervisors.
The Citizen Participation Plan currently requires the Urban County to publish all notices in the Monterey County Weekly, Gonzales Tribune, and El Sol newspapers. Publication in the Gonzales Tribune automatically results in publication in the Soledad Bee, Greenfield News, and the King City Rustler. The Citizen Participation Plan currently requires the Urban County to publish all notices of Substantial Amendments to Annual Action Plans in the Monterey County Weekly, Gonzales Tribune (including the Soledad Bee, Greenfield News, the King City Rustler, as noted), and El Sol newspapers. The proposed amendment to the Citizen Participation Plan would allow the Urban County to publish future notices in only the primary newspaper distributed in the community where the affected project is located as well as a Spanish notice in El Sol. This amendment may result in a slight administrative cost savings. The amendment also makes minor edits reflecting changes in Urban County participating jurisdictions as approved by the Board in the Consolidated Plan amendment, county staff changes, and the automatic publications noted above.
As part of the FY 2016-17 Action Plan, the Board of Supervisors approved Del Rey Oaks’ request to use Urban County CDBG funds to make improvements to the Del Rey Oaks City Hall in order to comply with the Americans with Disabilities Act (ADA). The City subsequently received additional CDBG Program Income which was added to the ADA project in the Second Substantial Amendment to the FY 2015-16 Action Plan. These ADA project improvements have been completed. The City has approximately $53,000 remaining that it would like to use to construct traffic calming improvements on Carlton Drive. There is no increase in funding associated with this Substantial Amendment.
As part of the FY 2016-17 Action Plan, the Urban County approved the City of Greenfield’s proposal to use CDBG funds to demolish and rebuild the restroom facility at Patriot Park. After further evaluating needs at Patriot Park, the City has requested that the scope of work be changed to remodeling the restrooms and constructing a concession stand, picnic facilities, and hardscape areas to facilitate ADA accessibility throughout the park. There is no increase in funding associated with this Substantial Amendment.
It is recommended that the Board of Supervisors approve the Amended Citizen Participation noticing requirements of the Consolidated Plan, the Third Substantial Amendment to the FY 2015-16 Action Plan, and the First Substantial Amendment to the FY 2016-17 Action Plan.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed the Substantial Amendments and the amendments to the Citizen Participation noticing requirement in Consolidated Plan, as to form. The Cities of Del Rey Oaks and Greenfield proposed the Substantial Amendments to the Action Plans.
FINANCING:
There is no impact to the General Fund as a result of the Board’s approval of the Amended Consolidated Plan or the two Substantial Amendments to the Urban County Action Plans. None of these amendments change existing CDBG funding allocations.
