b.  Authorize the Auditor-Controller to transfer $36,000 from the Productivity Investment Assignment 3125 Fund to the Information Technology Department (ITD)1930 INF002, Unit 8433 Fund, increasing estimated revenue and appropriations by $36,000 (4/5th vote required); and

c.  Approve and authorize the Director of Information Technology to execute a non-standard Agreement with Applied Geographics, Inc. for purchase of one Google Imagery License and one (1) year of technical support, for a total contract amount not to exceed $36,302.00 for the period of July 1, 2016 to June 30, 2017; and

d.  Authorize the Director of Information Technology to sign up to two (2) amendments to this Agreement, extending the term by one (1) year each, where the additional costs per year do not exceed ten percent (10%) of the original contract amount ($3,630.20), and where the amendments do not significantly change the scope of work and do not alter the non-standard terms of the Agreement; and

e.  Accept non-standard contract terms as recommended by the Director of Information Technology.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Authorize the release of $36,000 from the Productivity Investment Assignment 3125 Fund to be used by the Monterey County Assessor to purchase one (1) Google Imagery License and one (1) year of technical support (4/5th vote required); and

b.                     Authorize the Auditor-Controller to transfer $36,000 from the Productivity Investment Assignment 3125 Fund to the Information Technology Department (ITD) 1930 INF002, Unit 8433 Fund, increasing estimated revenue and appropriations by $36,000 (4/5th vote required); and

c.                     Approve and authorize the Director of Information Technology to execute a non-standard Agreement with Applied Geographics, Inc. for purchase of one Google Imagery License and one (1) year of technical support, for a total contract amount not to exceed $36,302.00 for the period of July 1, 2016 to June 30, 2017; and

SUMMARY/DISCUSSION:

The County of Monterey has not updated its Geographic Information System (GIS) aerial imagery since 2011. GIS has proven to be a significantly useful and important tool for the County.   GIS aerial imagery has many valuable applications that can be used by a majority of County Departments to serve the residents of Monterey County.   For example, both the Resource Management Agency and the Assessor need current imagery to inspect for code enforcement issues or to determine if non-permitted structures are present and be able to assess accordingly. The ability to complete this work from a computer rather than a personal visit to a property saves time and money for the County. Another example is in the event of a disaster, e.g., major fire, earthquake or flood, the updated imagery will provide a current photo of the impacted area and allow for quicker and more effective deployment of resources. GIS aerial imagery has many applications which will result in a higher level of service to the residents of Monterey County.

 

The County has the opportunity to secure current GIS aerial imagery for the entire county at 6” resolution from Google and its partner Applied Geographics, Inc. at a cost of $36,302. This is a fraction of the approximately $300,000 the County paid in 2009 for the same product.

 

The Budget Committee reviewed the proposed Google Imagery expenditure and supports the purchase.  It supports the request to release of $36,000 from the Productivity Investment Assignment 3125 Fund and authorize the Auditor to transfer $36,000 from the Productivity Investment Assignment 3125 Fund to the Information Technology Department (ITD) 1930 INF002, Unit 8433 Fund, to increase estimated revenue and appropriations by $36,000.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed the proposed Agreement and cannot approve due to the following non-standard terms: imposition of County liability for third-party breach of obligations, including confidentiality breaches, vendor’s right to change the terms of service, upon notice, non-standard payment terms (lump sum), deleted royalty terms; shortened statute of limitations, vendor’s right to suspend service, non-standard termination provisions, disclaimer and limitation of warranty, limitations on types of vendor liability and the amount of liability to amount of the contract, requirements for County to defend and indemnify vendor, and non-standard venue provisions.

 

FINANCING:

 $36,000.00 will be transferred from the Productivity Investment Assignment 3125 Fund to the Information Technology Department (ITD) 1930 INF002, Unit 8433 Fund to increase estimated revenue and appropriations by $36,000.  The remaining $302.00 will be paid from the GIS Repository Fund.
