RECOMMENDATION:

It is recommended that the Monterey County Water Resources Agency Board of Supervisors:

 

a. Accept the Certificate of Completion for the Moss Landing Tide Gate Emergency Repairs; and,

b. Authorize the General Manager of Monterey County Resources Agency to execute and record, within fifteen days with the County Recorder, a Notice of Completion for said public work pursuant to the provisions of California Civil Code Section 9204.

 

SUMMARY/DISCUSSION:

 

Emergency repairs were performed at the Moss Landing Tide Gate Facility, Moss Landing CA, under “Proclamation of Local Emergency” (“Proclamation”) by the Monterey County Board of Supervisors RES 15-101 No. 26.1, SC 9300 04925. The repairs were performed by Don Chapin Company and have been “Certified Complete” by the MCWRA Project Engineer. Acceptance of the Certificate of Completion releases the retention funds withheld to the contractor.

 

The Proclamation was made in response to increased water elevations and the introduction of seawater within the Moro Cojo Slough, normally a brackish and freshwater habitat. The Moss Landing Tide Gate Facility, located in Moss Landing, California had failed and was allowing seawater to enter unrestricted into the Moro Cojo Slough. The increased water elevations and salinity in Moro Cojo Slough posed a threat to several endangered and threatened species, domestic and agricultural fresh water supplies, and a flood risk to local residences and businesses in Moss Landing.

 

Under an emergency Purchase Order, authorized by Monterey County Purchasing, a “No Bid” contract was authorized for Don Chapin Company, Inc. to perform the emergency repairs. These repairs are considered a Capital Improvement requiring 10% of the cost of the repairs be retained until the project is deemed complete. The repair work at the Moss Landing Tide Gate Facility began January 4, 2016, and was completed January 11, 2016. A Certificate of Completion was signed by the Project Engineer on May 24, 2016.

 

The repairs consisted of removing approximately 10 cubic yards of material overlaying three corrugated metal culvert pipes that were leaking and preventing the tide gate facility from functioning properly. 600 geotextile sandbags, filled with a mix of sand and bentonite clay, were placed around the leaking culverts to restrict the inflow of seawater into the Moro Cojo Slough. 11 gabion rock baskets were constructed and placed over the sandbags.

 

The total cost of the Moss Landing tide gate Emergency Repair is $81,225.  Monterey County Water Resources Agency (MCWRA) and Resources Management Agency (RMA) the County are responsible for $40,612 each, as specified in the MCWRA/RMA MOU.  The Don Chapin Company portion of the repair work totaled $54,724, of which $5,472 (10%) was withheld.

 

The Emergency Repairs are designed to remain in place for a period of 12 to 18 months while a permanent solution to the tide gate facility failure is being designed. Work on the permanent solution design is currently underway.

 

Acceptance of the Certificate of Completion by the Board of Supervisors releases the retention funds withheld ($5,472) to Don Chapin Company.

 

OTHER AGENCY INVOLVEMENT:

 

Repair costs associated with the Moss Landing tide gate facility, emergency or permanent, are covered under the MCWRA/RMA MOU Cost Sharing Agreement. All repair cost will be split evenly between MCWRA and County RMA.

 

The Water Resources Agency Board of Directors approved this matter on June 27, 2016.

 

FINANCING:

 

The Agency’s portion of the repair invoice (50%) will be paid from Fund 127 (Zone 17).  The County’s 50% portion of the repair invoice will be paid from Fund 002-3000-8195-RMA012, Work Order 621020 based on the MCWRA/County MOU cost sharing agreement authorized by the Board of Supervisors on October 26 2015, and fully executed on February 23, 2016.
