Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                      Approve and authorize the Director of Health or Assistant Director of Health to execute a Mental Health Services Agreement with Lakemary Center for the provision of residential and psychiatric services to Monterey County youth that require a moderate to severe level of residential care, in the amount of $105,700 for Fiscal Year (FY) 2015-16, and $255,500 for FY 2016-17, for a total Agreement amount not to exceed $361,200 retroactive to February 1, 2016 through June 30, 2017; and

b.                      Approve and authorize the Director of Health or Assistant Director of Health to approve up to three (3) future amendments that do not exceed ten percent (10%) ($36,120) of the original Agreement amount and do not significantly alter the scope of services.

 

SUMMARY:

Founded in 1969, Lakemary Center in Paola, Kansas is a 65-bed Psychiatric Residential Treatment Facility (PRTF), licensed by the State of Kansas to provide educational and psychiatric treatment for children aged 6-21 years with dual diagnoses of intellectual and /or developmental disabilities and psychiatric disorders, including Autistic Spectrum Disorder.  Lakemary Center provides tailored services for children with deficits in a variety of adaptive functioning areas, including communication, self-care, functional academics, social skills, leisure skills, and community use skills.  Behavioral presentations addressed include high levels of aggression, self-injury, elopement, property destruction, and other high-risk behaviors. Lakemary Center was the only facility found nationally that would agree to take this high-risk youth.

 

DISCUSSION:

This new Agreement establishes one placement for a County of Monterey youth, beginning February 1, 2016 through June 30, 2017.  The term of this Agreement is retroactive to February 1, 2016, due to an emergency placement.  An emergency placement is necessary when current contracted providers are unable to provide the specialty mental health services a youth requires.  Normally our Agreements add capacity to provide for future placements at the facility, however in this case we anticipate only one placement due to the unique requirements of the patient.

 

This Agreement contains the County’s standard 30-day “no cause” provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.

This work supports the following Monterey County Health Department 2011-2015 strategic plan initiative: 3) Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7) Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively. A copy of this Agreement is on file with Clerk of the Board.

 

FINANCING:

This Agreement is 100% funded by Special Education Local Plan Area (SELPA) funds that pay for children who are placed through the Individual Education Plan (IEP).  The funds for this Agreement ($105,700) are included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year 2015-16 Adopted Budget.  The funds for this Agreement for FY 2016-17 ($255,500) will be included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year 2016-17 Recommended Budget.
