Authorize the Resource Management Agency Director and/or Resource Management Agency Deputy Director of Public Works and Facilities, to execute any Federal and/or State Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements and/or Fund Transfer Agreements with the California Department of Transportation.

RECOMMENDATION:

It is recommended that the Board of Supervisors authorize the Resource Management Agency Director and/or Resource Management Agency Deputy Director of Public Works and Facilities, to execute any Federal and/or State Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements and/or Fund Transfer Agreements with the California Department of Transportation.

 

SUMMARY/DISCUSSION:

Federal Master Agreement No. 05-5944R and State Master Agreement No. 00032S are agreements between the State of California and the County of Monterey to administer programs which include but are not limited to, the Regional Surface Transportation Program (RSTP), the Surface Transportation Program (STP) the Congestion Mitigation and Air Quality Improvement Program (CMAQ), the Transportation Enhancement Program (TE), the Highway Bridge Replacement Program (HBP), State Transportation Improvement Program (STIP), and Highway Safety Improvement Program (HSIP).  The Master Agreements include standard provisions relating to project administration, management and maintenance, as well as fiscal and special provisions common to all projects. 

 

The California Department of Transportation (Caltrans) has revised the federal Master Agreement to reflect the recent changes created by the “Supercircular,” otherwise known as 2 CFR 200 to keep up with the changing landscape of Federal-aid regulation.   It has been ten (10) years since the last federal Master Agreement revision and when 2 CFR 200 was published over a year ago, it consolidated some Office of Management and Budget (OMB) directives and did away with a few other regulations.  Caltrans has revised the Master Agreement to bring it into compliance and to address references to obsolete federal regulations and will issue this new agreement to a local agency upon receiving the new project request. Caltrans issued this new Federal Master Agreement No. 05-5944F15 to the County which is required in order to request an authorization for a new project (i.e. first authorization sequence) and for additional funds of the next phase of work.

 

Caltrans prepares Program Supplement Agreements for each project outlining eligible costs and reimbursement percentages for State and Federal funds, as well as special covenants applicable to each project.  Each of these supplements must be accepted and signed on behalf of the County by an authorized official approved by the Board of Supervisors.  RMA - Public Works and Facilities pursues Federal and State funding for several projects during each fiscal year, and therefore requests that the Resource Management Agency (RMA) Director or his designee, be the official, duly authorized by the Board to approve and sign the attached Federal Master Agreement NO. 05-5944F15 and to execute any Federal and/or State Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements and/or Fund Transfer Agreements with Caltrans on behalf of the County for existing and future projects that fall under Master Agreement NO. 05-5944F15.

The Resource Management Agency will return to the Board of Supervisors for approval prior to acceptance of any grant award.

 

OTHER AGENCY INVOLVEMENT:

Caltrans approves the proposed designation of the RMA Director or his designee as the authorized County official to accept and sign Federal and State Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements and/or Fund Transfer Agreements on behalf of the County.  Other counties currently use a similar funding acceptance procedure.

 

FINANCING:

Federal funding provided through the Master Agreements and Program Supplement Agreements are for County Roads, Bridges, and related construction projects.  Revenue received pursuant to the supplement agreements is deposited into the Road Fund toward reimbursement of project expenditures,
