Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and authorize the Chair to sign and issue to the Pacific Gas and Electric Company a Temporary Permit to Enter and Use Property on County-owned properties at the former Fort Ord, specifically APN 031-161-032 (East Garrison II - Locations “E” and “F”) and APN 031-101-056 (Landfill Border - Location “G”); and

b.                     Authorize the Director of the Resources Management Agency to approve amendments to this Temporary Permit to Enter, and any future permits to Pacific Gas and Electric for entry to the subject properties.

SUMMARY:

In 1997 the US Army granted PG&E an easement for its large regional gas and electric transmission lines across the breadth of Ft Ord.  Some of the properties where these lines are located are now owned by the County.  As part of an on-going state-wide safety program, PG&E wishes to enter the easement at three locations on County-owned property to perform hydrostatic testing on its existing 10” and 4” gas transmission mains this summer.  PG&E has asked that the County issue a Temporary Permit to Enter and Use Property to document that the County concurs with the terms and conditions of its doing this testing.

DISCUSSION:

The County of Monterey became owner of APN 031-161-032 (East Garrison II Parcel L23.3.3.1) by a Quitclaim Deed from the Successor Agency to the Redevelopment Agency of the County of Monterey approved and accepted by the Board of Supervisors on May 17, 2016.  The County of Monterey became owner of APN 031-101-056 (Landfill Border Parcel E8a.1.1.2) on August 23, 2016 by Quitclaim Deed from Successor Agency to the Redevelopment Agency of the County of Monterey.

PG&E has major regional gas and electric transmission facilities within the former Fort Ord area that require routine maintenance, some of which are located on property now owned by the County.  As part of an on-going system-wide safety program, PG&E has retained a contractor to perform hydrostatic testing of its existing gas transmission line on the public utility easement crossing County-owned property at the following locations:

Barloy Canyon Road & Border Road, APN 031-161-032

Sloat Street & Watkins Gate Road, APN 031-161-032

8th Avenue & Engineering Equipment Road, APN 031-101-056

The Temporary Permit to Enter and Use Property will document the County’s terms and conditions for PG&E’s contractor to enter their easement on these properties for the purpose of vegetation management, excavation activities, storing construction materials, equipment and parking vehicles in conjunction with performance of the T-1051 Hydrostatic Pressure Testing of PG&E’s underground gas transmission facilities

PG&E prepared an Arborist Evaluation to determine the measures necessary to protect the vegetation and habitat over and adjacent to the testing areas.  County RMA-Planning reviewed this report and determined its recommendations are adequate.  The report is included in the Temporary Permit to Enter.

PG&E has determined that this project is exempt from CEQA because hydrotesting of existing pipeline facilities falls under a Class 1 Categorical Exemption under CEQA (CEQA Guidelines Section 15301(b)).

The work is scheduled to be performed from September 7 through December 30, 2016.  An option is provided for PG&E to extend the term of this Permit for up to two (2) months by providing written notice to the County.

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel has reviewed the Temporary Permit to Enter and Use Property at to form.

FINANCING:

The recommended action will have no financial impact to the County General Fund.  PG&E will pay all costs related to their gas line hydrostatic testing project and site restoration as described in the Permit.
