Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                      Approve and authorize the Director of Health or Assistant Director of Health to execute a three (3) year Mental Health Services Agreement with Loving Care Residential Homes, Inc. to provide mental health services to Monterey County adult residents with severe psychiatric disabilities in the amount of $118,625 for Fiscal Year (FY) 2016-17, $118,625 for FY 2017-18, and $118,625 for FY 2018-19, for a total Agreement amount not to exceed $355,875, retroactive to July 1, 2016 through June 30, 2019; and

b.                      Approve and authorize the Director of Health or Assistant Director of Health to approve up to three (3) future amendments that do not exceed ten percent (10%) ($35,588) of the original Agreement amount and do not significantly alter the scope of services.

 

SUMMARY/DISCUSSION:

This new Mental Health Services Agreement with Loving Care Residential Homes, Inc.  replaces Agreement A-12435, which expired on June 30, 2016.  Loving Care Residential Homes, Inc. is a licensed Residential Care Facility for the Elderly authorized by the State of California Department of Social Services, as defined in Section 1569 of the Health and Safety Code.  The facility provides community-based living for adults sixty (60) years of age or older with varying levels of care and supervision needs and up to twenty-five percent (25%) of the total census to be adults under age sixty (60) with compatible service needs.  This Agreement will provide for up to twenty-six (26) Monterey County Behavioral Health Bureau (MCBHB) clients for a daily patch rate of twelve dollars and fifty cents ($12.50) per client to accommodate difficult to place MCBHB clients with severe psychiatric disabilities requiring access to a higher level of mental health services. Approval of this Agreement provides for the continuity of care to adults with severe psychiatric disabilities and complies with the requirements of the Welfare and Institutions Code Section 5600 (Bronzan-McCorquodale Act).

 

This Agreement is delayed in being brought before your Board due to several factors including lengthy contract negotiations and fiscal year-end workload issues. This Agreement contains the County’s standard 30-day “no cause” provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.

 

This proposed Agreement supports the Monterey County Health Department 2011-2015 strategic plan initiatives: 1) Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7) Link people to needed personal health services and assure the provision of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively. This Agreement is on file with Clerk of the Board

 

FINANCING:

This Agreement is funded by Realignment revenue.  The funds for this Agreement ($118,625) are included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year (FY) 2016-17 Adopted Budget.  The funds for this Agreement for FY 2017-18 ($118,625) and FY 2018-19 ($118,625) will be included in the respective Health Department’s Behavioral Health (HEA012, Unit 8410) FY 2017-18 and FY 2018-19 Requested Budgets.
