Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

Receive the Notice of Adjustment of the Annual Salary of the Members of the Board of Supervisors, consistent with the salary increases of 1.83 percent (1.83%) for Fiscal year 2014-15 and 2.4 percent (2.4%) for Fiscal Year 2015-16 provided to the Judges as provided in Section 2.04.370C of the County of Monterey Code, effective September 17, 2016; retroactive to July 1, 2014 for FY 2014-15 and retroactive to July 1, 2015 for FY 2015-16.

SUMMARY/DISCUSSION:

Section 2.04.370C of the County of Monterey Code mandates that salary of the members of the Board of Supervisors be adjusted by the same percentage rate applicable to that of the Municipal (now Superior) Court Judges.  By direction of the Judicial Council of California, the Judges of Monterey County received a 1.83 percent salary increase for Fiscal Year 2014-15 effective July 1, 2014 and a 2.4 percent increase for Fiscal Year 2015-16 effective July 1, 2015.

Under Section 2.04.370C notice of the adjustment shall be included on the agenda of a regular meeting of the Board of Supervisors at least ten days prior to the effective date.  As such, this salary adjustment pursuant to the Code will be made effective on September 17, 2016 (the beginning of the pay period that is ten days after the Board Meeting date).  This salary adjustment is consistent with the implementation Memorandums from the Judicial Council of California (attached) retroactive to July 1, 2014 and July 1, 2015.

Please note that the adjustments provided in Section 2.04.0370C are automatic; action by the Board of Supervisors is not required or necessary for this adjustment to go into effect.

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed this report.

FINANCING:

The salary adjustments will result in retroactive costs of approximately $31,971 and annualized salary and benefits increase of approximately $31,971 for a total cost of approximately $63,942 for FY 2016-17.  The salary adjustments were not included in the recently adopted budget for FY 2016-17.  To the extent salary increases cannot be absorbed within existing budget, staff will need to identify alternative funding sources.  The increased future year cost will be included in the department’s FY 2017-18 budget request.
