RECOMMENDATION:
It is recommended that the Board of Supervisors consider approval and authorize the Chair of the Board of Supervisors to execute and send a letter to the State Water Resources Control Board regarding California-American Water Company's request to modify Cease and Desist Order WR 2009-0060.
SUMMARY/DISCUSSION:
On November 20, 2015, California-American Water Company (CalAm) submitted a request to modify the State Water Resources Control Board (SWRCB) Cease and Desist Order (CDO) WR 2009-0060, which restricts pumping on the Carmel River. On April 28, 2016, CalAm filed an amended application requesting an extension of the compliance timeline until December 31, 2021, and other changes to the initial application.
The SWRCB released a Preliminary Staff Recommendation related to CalAm's request on June 17, 2016. The SWRCB anticipates considering whether to make changes to CDO 2009-0060 at a SWRCB Board Meeting, on or about July 19, 2016.
This report seeks the approval and authorization of the Board of Supervisors to have the Chair of the Board of Supervisors send a letter with the County's comments related to these matters to the State Water Resources Control Board.
