Title: a. RECOMMENDATIONS:

It is recommended that the Board of Supervisors:

 

a.   Approve Amendment No. 6 to Agreement No. A-12485 with North State Environmental to continue to provide hazardous waste management services for the County of Monterey Resource Management Agency (RFP #10279) to increase the not to exceed amount of $199,900 by $100,000 for a total amount not to exceed $299,900 and extend the expiration date from October 4, 2016 for two (2) additional years through October 4, 2018, for a revised term from October 4, 2011 to October 4, 2018; and

b.   Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 6 to Agreement No. A-12485 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved amount of the Agreement.

 

SUMMARY:

The County of Monterey Resource Management Agency (RMA) has identified a continued need for North State Environmental (NSE) to provide hazardous waste management services (services) whereby RMA reports any non-County generated hazardous/potentially hazardous waste left on the side of County roadways to NSE and requests pickup, transport and disposal of this hazardous/potentially hazardous waste. 

 

Attachment A provides a summary of the Agreement to date.

 

DISCUSSION:

NSE was initially selected for their expertise and capabilities necessary to provide these services through a competitive selection process in accordance with County policies under Request for Proposals (RFP) #10279.  Per the terms of RFP #10279 and the existing Agreement with NSE, services were to expire no later than five (5) years on October 4, 2016.  On March 17, 2016 (prior to expiration of the existing Agreement), RMA solicited for proposals from qualified consultants through a new RFP #865202 for Hazardous Waste Management Services.  However, no proposals/bids were received in response to the new RFP.  RMA has contacted NSE who has agreed to continue to provide the services under the existing Agreement at the original rates for an additional two (2) year period.

 

This Amendment No. 6 will increase the not to exceed amount of $199,900 by $100,000 for a total amount not to exceed $299,900 and extend the expiration date from October 4, 2016 for two (2) additional years through October 4, 2018, for a revised term from October 4, 2011 to October 4, 2018 (beyond the anticipated five (5) year Agreement term for a total term of seven (7) years).

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel, Risk Management Office and Auditor-Controller Office have reviewed and approved Amendment No. 6 as to form and legality, and indemnity and insurance and fiscal provisions, respectively.

 

FINANCING:

There is no financial impact to the General Fund.   The FY 2016-17 Adopted Budget includes appropriations associated with services provided for by North State Environmental.  Litter Control Unit 8194, Department 3000, Appropriation RMA002 budgeted amount is $20,000 and Road Fund Unit 8443, Department 3000, Appropriation RMA012 budgeted amount is $15,000.  While actual expenditures will depend on quality and type of materials tested, picked up and disposed of, the budgeted amounts should be sufficient to cover these expenditures.
