RECOMMENDATION:

It is recommended that the Monterey County Water Resources Agency Board of Directors:

 

Approve and recommend that the Monterey County Water Resources Agency Board of Supervisors approve the execution of an Agreement for Taxing Entity Ccompensation with the City of Soledad pursuant to Health and Safety code section 34180(f); and conveyance of real property in the former redevelopment plan area to the City of Soledad from the successor Agency to the former Soledad Redevelopment Agency. 

 

SUMMARY/DISCUSSION:

 

On June 7th, 2016 Mark Hartunian of the City of Soledad provided an oral presentation to the Board of Directors requesting approval of a Master compensation aAgreement for Taxing Entity Compensation with the City of Soledad pursuant to Health and Safety code section 34180(f), which also called for the; and conveyance of real property in the former redevelopment plan area to the City of Soledad from the successor Agency to the former Soledad Redevelopment Agency.

 

Upon review of the Master Aagreement by Agency County Counsel, the following changes were made to the agreement, which and they have been approved (with further revisions) by the City of Soledad attorneys:

                     Elimination of sale price deductions (from the Agency’s share) for marketing, consultants, and other unspecified fees consultants, and “other” expert fees;

                     Inserted conditions for post-sale City Accounting by the City to the County Auditor and for reserved the right for the County Auditor’s right to audit the sale;

                     Made the agreement a two-party agreement (not a master agreement), since other entities had already signed off on the agreement.

                     Deleted reference to parcels that are not part of the impending sale by the Seaside Successor Agency to a private commercial developer.

 

The report is now ready for approval from by the Agency Board of Directors, and recommendation for final approval by the Agency Board of Supervisors.

 

OTHER AGENCY INVOLVEMENT:

 

County Counsel assisted with the revision of the Agreement and preparation of this report. Other taxing entities have reviewed and approved the Master Agreement proposed by Soledad.  The County of Monterey (including the library district) are expected to take action similar to that by the Agency Board of Supervisors.

 

FINANCING:

 

The City of Soledad shall remit Net Unrestricted Proceeds arising from this transaction to the Monterey County Auditor-Controller’s Office (“Auditor-Controller”) for distribution to all Taxing Entities, including MCWRA.
