RECOMMENDATION:
It is recommended that the Board of Supervisors:
Continue to April 18, 2017, the public hearing on the proposed amendments to the 2010 Monterey County General Plan ("General Plan") that would implement a settlement of litigation regarding the General Plan.

SUMMARY/DISCUSSION:
On May 12, 2015 the Board of Supervisors considered proposed amendments to the 2010 General Plan, the adoption of which would implement settlement agreements concerning the two remaining lawsuits challenging the 2010 General Plan. At that time the Board opened the public hearing and received public testimony, but took no action and continued the hearing on the item to September 29, 2015, with the direction that staff attempt to resolve objections that interested parties and stakeholders expressed regarding the proposed amendments. The hearing on the matter has been continued several times to allow for further discussions; most recently it was continued to December 14, 2016; however, the scheduled meeting that day will be cancelled.

The parties are considering whether further progress on a settlement is possible, and representatives of the agricultural industry and the litigants are continuing to meet.
