a. Approve Amendment No. 3 to the Professional Services Agreement with Kimley-Horn and Associates, Inc. to provide plan review support services for Phase 3 of the East Garrison Subdivision to increase the not to exceed amount of $50,000 by $84,800 for a total amount not to exceed $134,800, with no extension to the Agreement’s term beginning March 17, 2014 through June 30, 2019; and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 3 to the Professional Services Agreement and execute future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 3 to the Professional Services Agreement with Kimley-Horn and Associates, Inc. to provide plan review support services for Phase 3 of the East Garrison Subdivision to increase the not to exceed amount of $50,000 by $84,800 for a total amount not to exceed $134,800, with no extension to the Agreement’s term beginning March 17, 2014 through June 30, 2019; and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 3 to the Professional Services Agreement and execute future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved Agreement amount.
SUMMARY/DISCUSSION:
On March 26, 2014, the County’s Contracts/Purchasing Deputy Purchasing Agent executed a Professional Services Agreement (PSA) with Kimley-Horn and Associates, Inc. (KHA) to provide plan review support services on behalf of the County for the East Garrison Phase 2 subdivision improvements for a total amount not to exceed $50,000 with a term to expire on March 31, 2015. On March 23, 2015 the PSA was amended to extend the term through June 30, 2016 (Amendment No. 1). On June 30, 2016 the PSA was amended to extend the term through June 30, 2019 (Amendment No. 2).
The East Garrison developer has indicated their intention to submit the proposed Final Subdivision Map and Infrastructure plans for Phase 3 of the subdivision in January 2017 and request County staff review and submittal for approval by the Board of Supervisors in April 2017. Given the extensive and complex nature of the required review, and the history KHA has with this specific project, it is recommended that KHA’s services be continued to assist County staff in its review of these documents.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 3 as to form and legality, and fiscal provisions, respectively.
FINANCING:
This action will have no financial impact to the General Fund. All costs for the County’s review of infrastructure improvements at East Garrison are reimbursed by the developer. The Fiscal Year 2016-17 Adopted Budget for Fund 182, Appropriation Unit DEO028 has sufficient appropriations for this PSA.
