RECOMMENDATION:

It is recommended that the Board of Supervisors:

Approve and Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to sign Amendment #6 to Agreement A-12200 between the Monterey County Sheriff’s Office and Probation Department and California Forensic Medical Group, Inc. (CFMG) for adult inmate and juvenile ward medical services, extending the agreement expiration date from January 31, 2017 to March 31, 2017, at an estimated total cost for nine months in the FY 2016-17 of $5,974,411 for the Monterey County Sheriff’s Office, and $580,500 for the Probation Department to allow additional time for contract negotiations.

 

DISCUSSION:

 

California Forensic Medical Group, Inc. (CFMG) has been the provider of inmate medical services at the Monterey County Jail and at Monterey County Probation facilities since July 1, 1989. This particular contract (A-12200) was awarded April 1, 2012 via a Request for Proposals (RFP) process. The annual cost of this contract for the direct medical service provision within the Jail in FY 2015-16 was $7,580,778 and Probation’s direct medical services cost for FY 2015-16 was $737,932.

 

The implementation plan for the execution of the settlement agreement reached in the Hernandez litigation affecting the Adult inmate population has been finalized, and parameters established for negotiation, and this extension is being requested to complete negotiations.

 

A copy Agreement A-12200 and all associated amendments is on file at the Clerk to the Board’s Office.

 

OTHER AGENCY INVOLVEMENT:

 

County Counsel has approved the agreement as to legal form, and the Auditor-Controller has reviewed for fiscal provisions. The Probation Department is also a party to this agreement and concurs with the need to extend the agreement to complete negotiations. 

 

FINANCING:

 

A full year’s funding for this contract was included in both the FY 2016-17 Sheriff’s Office and Probation Department’s approved budgets, based on FY 2015-16 expenditures and contract terms. The FY 2016-17 Sheriff’s approved budget allowed for a 4.1% increase on this contract; Probation’s budget allowed for a 3.9% increase. The final Cost of Living increase approved for FY 2016-17 on Amendment #4 was 4.77%, and this amendment was approved after budget approval. Up to March 31, 2017, the only increase in contract amount is due to budgeted versus actual Cost of Living increases, which are estimated at $58,757 more than included in the Sheriff’s FY 2016-17 approved budget and estimated at $5,768 more than included in Probation’s FY 2016-17 approved budget.
