RECOMMENDATION:

It is recommended that the Board of Supervisors approve Amendment 1 to the Joint Occupancy Agreement between the Judicial Council of California and the County of Monterey effective March 1, 2017

 

SUMMARY/DISCUSSION:

The County has been in negotiations with the Judicial Council of California regarding an amendment to the Joint Occupancy Agreement between the Judicial Council of California and the County of Monterey.  The amendment causes the Judicial Council to act as Managing Party and the County as Contributing Party with respect to operation of the elevators at the Monterey Courthouse Building.  It additionally broadens the Judicial Council’s ability to respond to emergencies at the Monterey Real Property.  The amendment adds clarifying language to the agreement regarding notifications and contacts during repairs and emergency repairs. Responsibility for the existing Court facility located in the Monterey Courthouse Building transferred from the County to the Judicial Council pursuant to the Transfer Agreement March 30, 2009, and management of the Parties’ joint use of the Monterey Real Property is controlled by the “Joint Occupancy Agreement between the Judicial Council of California, Administrative Office of the Courts and the County of Monterey” dated March 30, 2009 (the “JOA”).

OTHER AGENCY INVOLVEMENT:

Staff from the County Administrative Office, County Counsel, and Public Works and the Resource Management Agency, have been involved in the negotiation process with the Judicial Council.

 

FINANCING:

No financial terms were changed as part of the amendment.
