Approve and recommend that the Monterey County Water Resources Agency Board of Supervisors:
a. Approve a Budget Amendment for the Monterey County Water Resources Agency’s Fiscal Year 2016-17 Adopted Budget for the Bryant Canyon Channel Improvement Project; and,
b. Authorize the Auditor Controller’s Office to increase appropriations in the Monterey County Water Resources FY 2016-17 Adopted Budget for the Bryant Canyon Fund 121-9300-8267-WRA011 in the amount of $75,000 financed by the unassigned fund balance in Fund 121-9300-8267-WRA011 (4/5th vote required).
c. Authorize the Auditor Controller’s Office to incorporate the approved appropriation and estimated revenue modifications to the Monterey County Water Resources Agency’s FY 2016-17 Budget, and the County Administrative Office to reflect these approved changes in the FY 2017-18 Adopted Budget.

It is recommended that the Monterey County Water Resources Agency Board of Directors:

SUMMARY/DISCUSSION:
Zone 8, Fund 121 includes the Bryant Canyon Drainage Area and select facilities within that area. Zone 8 funds are available to maintain the Soledad Storm Drain in accordance with an agreement by the Monterey County Water Resources Agency (MCWRA) with the City of Soledad and the Department of Housing and Urban Development. In addition, the funds can be used to operate and maintain the extension of the Storm Drain along Bryant Canyon Road (Bryant Canyon Channel).
The original Soledad Storm Drain was constructed by the U.S. Department of Housing and Urban Development (HUD) in 1974 to reduce flooding in the City of Soledad from water flowing out of Bryant Canyon. Several flows from Bryant Canyon bypassed the channel inlet causing flooding within the city so the MCWRA proposed extending the inlet to reduce the flood risk and commenced construction of the Bryant Canyon Channel Improvement Project in 2002. The MCWRA did not have adequate funds in Zone 8, Fund 121 to complete the remaining pieces of the project.
UCP has been developing the Miravale Subdivision in the vicinity of the partially completed Bryant Canyon Channel Improvement Project. The City of Soledad authorizes construction of the proposed subdivision and has executed a Development Agreement with UCP that includes restrictions on specific lots until the unfinished improvements to the Bryant Canyon Channel Improvement Project have been made. UCP and the MCWRA have drafted a Subdivision Improvement Agreement (SIA) to be executed prior to commencement of construction of these improvements. The SIA is tentatively scheduled to be brought to the Board of Directors for approval in March 2017 and to the MCWRA Board of Supervisors shortly thereafter.
Substantial progress has been made towards construction of the improvements including the preparation of Permit Ready Construction Plans and Specifications and progress on obtaining all necessary permits to allow the construction. The construction is proposed to commence in May 2017. Additional fees are requested to obtain all necessary permits from State agencies requiring a fee. Those amounts are estimated at this time to be approximately $75,000.

FINANCING:
There is sufficient fund balance in the FY 2016-17 Budget for Fund 121 in the amount of $112,490 to cover the $75,000 in expenditures of for the requested construction permits.
