Approve and authorize the Chair to execute the Agreement Terminating Memorandum of Agreement Concerning the Realignment of the Multi-Modal Corridor Transit on the Former Fort Ord.

RECOMMENDATION:

It is recommended that the Board of Supervisors, acting as the Board of Directors of the Successor Agency to the Redevelopment Agency of the County of Monterey approve and authorize the Chair to execute the Agreement Terminating Memorandum of Agreement Concerning the Realignment of the Multi-Modal Corridor Transit on the Former Fort Ord.

 

SUMMARY/DISCUSSION:

The Fort Ord Base Reuse Plan includes the designation of a multi-modal corridor along the “Imjin Parkway/Blanco Road” corridor.  In 2010, the Fort Ord Reuse Authority (FORA), the Former Redevelopment Agency, and several other local agencies entered a Memorandum of Agreement Concerning the Realignment of the Multi-Modal Transit Corridor on the Former Fort Ord (2010 MOA) to agree to cooperate to process a new alignment (hereafter the “2010 alignment”).

 

Due to the desire of the parties to the 2010 MOA to reassess the 2010 Alignment, the Transportation Agency for Monterey County (TAMC) led the development of a Marina-Salinas Multi-Modal Corridor Conceptual Plan, which identified a new alignment based on input from the parties, stakeholders and the public.  On June 24, 2015, TAMC approved the Marina-Salinas Multi-Modal Corridor Plan (TAMC Resolution 2015-15.)

 

As result of the realignment and conceptual plan, a new memorandum of agreement has been drafted. The Successor Agency is not a party to the new agreement, but does need to approve termination of the 2010 MOA. Therefore, the Board is asked to approve the proposed Agreement Terminating the 2010 Memorandum of Agreement (Attachment A to the staff report).

 

The proposed parties to the new MOA are FORA, the City of Marina, the City of Salinas, California State University Monterey Bay, University of California Santa Cruz, Monterey-Salinas Transit District, TAMC, and the County.

 

The termination of the 2010 MOA is not a project under California Environmental Quality Act (CEQA) guidelines pursuant to section 15387 (b) (5) because this an administrative activity of the Successor Agency.

 

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel has reviewed the Agreements as to form.  TAMC led the development of a Marina-Salinas Multi-Modal Corridor Conceptual Plan, which identified the new alignment.  All the signing parties to the 2010 MOA, except the County of Monterey and the Successor Agency, have approved termination of the 2010 MOA.

 

FINANCING:

There is no impact to the Successor Agency to approve terminating the existing agreement and the Successor Agency is not party to the new agreement.
