RECOMMENDATION:

It is recommended that the Board of Supervisors:

Approve and authorize the Director of Health or Assistant Director of Health to execute a no-extension Amendment No. 1 to Mental Health Services Agreement A-13270 with Loving Care Residential Homes, Inc. for the provision of mental health services for Monterey County adult residents with severe psychiatric disabilities, increasing the total amount of the Agreement to add an Enhanced Services patch rate, and to increase the Standard Services daily patch rate, for a new maximum County obligation of $627,275 effective April 1, 2017 for the full term of July 1, 2016 through June 30, 2019.

 

SUMMARY/DISCUSSION:

Loving Care Residential Care Homes Inc. is a licensed Residential Care Facility for the Elderly authorized by the State of California Department of Social Services, as defined in Section 1569 of the Health and Safety Code.  The facility provides community-based living for adults sixty (60) years of age or older with varying levels of care and supervision needs. The facility’s license allows for up to twenty-five percent (25%) of the total census to be adults under age sixty (60) with compatible service needs.  Monterey County Behavioral Health Bureau (MCBHB) has a long-standing relationship with Loving Care Residential Care Homes, Inc. and as of May 1, 2017 will pay this vendor a daily patch rate of fourteen dollars ($14.00) per client, to accommodate up to twenty-five (25) difficult to place MCBHB clients with severe psychiatric disabilities requiring access to a higher level of mental health services.

 

In addition to the standard daily patch rate described above, effective April 1, 2017 this Amendment No. 1 to A-13270 establishes an Enhanced Service supplemental daily patch rate of three-hundred dollars ($300.00) for a single MCBHB client who requires 24-hour monitoring and an extensive range of highest-level 1-to-1 care.  This new rate fills an important gap in local enhanced care for elderly mentally disabled Monterey County residents, without the need to contract with a more expensive non-local facility.  Approval of this Agreement provides for the continuity of care to adults with severe psychiatric disabilities and complies with the requirements of the Welfare and Institutions Code Section 5600 (Bronzan-McCorquodale Act).

 

This Agreement contains the County’s standard 30-day “no cause” provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.

 

This work supports the following Monterey County Health Department 2011-2015 strategic plan initiative: 3) Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7) Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively.

 

FINANCING:

This Agreement is 100% funded by 1991 Realignment funding.  The funds for this Agreement ($143,650) are included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year 2016-17 Adopted Budget.  The funds for this Agreement for FY 2017-18 ($237,250), and for FY 2018-19 ($246,375) will be included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year 2017-18 and Fiscal Year 2018-19 Requested Budgets.
