a. Approve and authorize the Director of the Department of Social Services to sign an agreement with Safran MorphoTrust USA, LLC for $2,290.44 to provide preventative maintenance for the TouchPrint Live Scan system for the term of May 23, 2017 to April 30, 2018, including nonstandard liability provisions; and
b. Authorize the Director of the Department of Social Services to sign up to three (3) amendments to this Agreement where the total amendments do not exceed 10% ($229) of the original contract amount, and do not significantly change the terms of this Agreement.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of the Department of Social Services to sign an agreement with Safran MorphoTrust USA, LLC for $2,290.44 to provide preventative maintenance for the TouchPrint Live Scan system for the term of May 23, 2017 to April 30, 2018, including nonstandard liability provisions.
b. Authorize the Director of the Department of Social Services to sign up to three (3) amendments to this Agreement where the total amendments do not exceed 10% ($229) of the original contract amount, and do not significantly change the terms of this Agreement.
SUMMARY/DISCUSSION:
This Agreement provides ongoing maintenance for the Safran MorphoTrust TouchPrint Live Scan product used by the Monterey County Department of Social Services (DSS) to conduct fingerprint imaging for background checks. DSS conducts fingerprint imaging background checks on potential new hires (pre-hire) and potential resource families before a child is placed in their care. The fingerprint images are used to conduct a background check against a Department of Justice (DOJ) criminal database.
The maintenance agreement includes technical support for the Safran MorphoTrust TouchPrint Live Scan Product, TouchCare Support center for problem escalation, and parts and components necessary for the service and maintenance of the system.
DSS has been contracting with Safran MorphoTrust for this service for over five years and recommends that your Board approve this Agreement which includes nonstandard liability provisions.
OTHER AGENCY INVOLVEMENT:
Agreement is funded by Social Services Federal, State, and County realignment funds. The Auditor-Controller and Purchasing have reviewed and approved this agreement. County Counsel has approved the agreement as to form. Risk Management has reviewed, but cannot approve nonstandard Liability provisions.
FINANCING:
This agreement is funded with Federal, State, and County General Funds. Sufficient appropriations and revenues are included in the SOC005 Unit of the FY2016-17 Adopted Budget and has been included in the FY2017-18 Recommended Budget. Approval of this action has no additional impact on the County General Fund contributions.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
This Agreement correlates to the Public Safety and Health & Human Services Strategic Initiatives adopted by the Board of Supervisors by allowing the Department to improve the quality of life for Monterey County families by expanding the Department’s ability to protect the youths placed with caregivers and the employees they hire.
