RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                      Approve and authorize the Director of Health or Assistant Director of Health to execute a new three (3) year Mental Health Services Agreement with John Muir Behavioral Health Center in Concord, CA for the provision of specialty inpatient professional and mental health services for Monterey County children, adolescent and adult residents with psychiatric disabilities in the amount of $50,000 for Fiscal Year (FY) 2016-17, $50,000 for FY 2017-18, and $50,000 for FY 2018-19, for a total Agreement amount not to exceed $150,000 retroactive to July 1, 2016 through June 30, 2019; and

b.                      Approve and authorize the Director of Health or Assistant Director of Health to approve up to three (3) future amendments that do not exceed ten percent (10%) ($15,000) of the original Agreement amount and do not significantly alter the scope of services.

 

SUMMARY/DISCUSSION:

John Muir Behavioral Health Center (JMBHC) is the only private psychiatric facility in Contra Costa County and the only provider of child and adolescent inpatient psychiatric services in the region.  Monterey County does not currently have this type of facility and therefore relies solely on out-of-county facilities such as JMBHC.  JMBHC provides specialty inpatient and partial hospital day (Day Treatment Intensive Full Day) services for youth, ages twelve (12) to eighteen (18) years old, designed to assure appropriate psychiatric treatment within a secure setting.

 

For several years, the Health Department, Behavioral Health Bureau has entered into agreements with JMBHC for the provision of inpatient and day treatment psychiatric services to Monterey County clients, primarily adolescents.  The prior Agreement A-11290 expired on June 30, 2011.  This new Agreement assures the admission of Monterey County children, adolescents and adults, when appropriate, to this facility.

 

In July 2016, the County began working diligently with JMBHC to establish the new Agreement, however the negotiation period was much longer than anticipated.  Once both parties agreed, an additional two months lapsed before JMBHC was able to sign and return the Agreement for execution by the County.  Approval of this Agreement, retroactive to July 1, 2016, allows the County to meet our financial obligation to JMBHC who have continued to treat severely ill Monterey County children and adolescents throughout the Agreement negotiation process.  Due to the critical nature of services needed by these individuals, services were provided with the understanding contract negotiations were ongoing.

 

This Agreement contains the County’s standard 30-day “no cause” provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.

 

This work supports the following Monterey County Health Department 2011-2015 strategic plan initiative: 3) Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7) Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively.

 

FINANCING:

This Agreement is 100% funded by 2011 Realignment (Managed Care) revenues.  The funds for this Agreement ($50,000) are included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year (FY) 2016-17 Adopted Budget.  The funds for this Agreement for FY 2017-18 ($50,000) and FY 2018-19 ($50,000) will be included in the respective Health Department’s Behavioral Health (HEA012, Unit 8410) FY 2017-18 and FY 2018-19 Requested Budgets.
