Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

1.                     Approve and Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment #4 to Board Agreement #A-12460 with the County of Alameda to provide housing/bed space for county inmates in the Santa Rita Jail to extend this agreement until June 30, 2018 at a cost of $125.00 per inmate per day (estimated cost of $182,500 for Fiscal Year 2017-18); and

2.                     Authorize the Contracts/Purchasing Officer or Contracts Purchasing Supervisor to approve up to three (3) future amendments to this agreement where the amendments to the agreement do not increase the daily rate of the agreement and do not exceed annual AB109 funded amounts.

 

SUMMARY

 

The Sheriff requests re-approval of Board Agreement A-12460 with the County of Alameda for housing of inmates at the Santa Rita Jail. 

 

DISCUSSION

 

Your Board originally approved Agreement A-12460 with the County of Alameda for housing of inmates at the Santa Rita Jail. At that time, the Monterey County Jail was at approximately 130% of its rated capacity of 824 inmates.  The Board chose to exercise an option made available under Senate Bill 1021, which allowed counties where adequate jail facilities were not available to enter into agreements with the Board of Supervisors of one or more nearby counties where adult detention facilities were adequate and had additional space to house inmates. The jail remains in an over capacity state, and will remain in that state until the proposed expansion has been completed.

 

The Alameda County Sheriff provides custody and care of Monterey County inmates pursuant to Minimum Standards for Local Detention Facilities as set forth in California Code of Regulations Titles 15 and 24, and in accordance with all Federal, State and local laws. Inmates are provided the same full range of medical care inside the facility as is provided to Alameda County inmates.

 

This agreement has been extended three times via amendment, which was the number of amendments approved by your Board. The Sheriff would like to continue the agreement with Amendment #4 to allow for operational flexibility during construction, and is therefore, presenting this agreement to you again, for authorization of Amendment #4 and three subsequent amendments.

OTHER AGENCY INVOLVEMENT

 

The Community Corrections Partnership (CCP) has approved funding for this Agreement from AB 109 funds, as per the annual request for funding submitted by the Sheriff’s Office. County Counsel has reviewed the agreement as to legal form, and the Auditor-Controller has reviewed its fiscal provisions.

 

FINANCING

 

This Agreement has been reimbursed from AB109 funding since its inception, and was included in the Approved Fiscal Year 2016-17 budget, and is also included in the proposed Fiscal Year 2017-18 budget in the amount of $182,500. Continuation of this Agreement is dependent on AB 109 funding.

This contract meets the Board’s strategic initiatives by effectively using county resources and reducing overcrowding at the Monterey County Jail.
