RECOMMENDATIONS:

It is recommended that the Board of Supervisors:

a.                     Approve Amendment No. 3 to Agreement No. A-13267 (Multi-Year Agreement (MYA) #3000 *1633) with The Labor Compliance Managers to continue to provide services associated with on-call labor compliance monitoring services as it relates to the East Garrison Development Project under Request for Qualifications (RFQ) #10422, to increase the not to exceed amount of $232,400 by $120,000 for a total amount not to exceed $352,400 and to extend the expiration date from December 31, 2017 for one (1) additional year through December 31, 2018, for a revised term from December 1, 2013 to December 31, 2018; and

b.                     Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 3 to Agreement No. A-13267; and

c.                     Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute future amendments to Agreement No. A-13267 as they relate to the East Garrison Development Project to extend the term beyond the original term authorized in RFQ #10422 where the amendments do not significantly alter the scope of work or change the approved Agreement amount.

 

SUMMARY:

Over the last five (5) years, the County of Monterey’s Resource Management Agency (RMA) has established several on-call agreements by prequalifying professional firms in specialized fields.  The purpose of having on-call consultants is to expedite the procurement process when needing specialized expertise from a professional firm when County staff lacks the expertise or when the volume of work exceeds RMA’s capacity.  These on-call agreements are utilized across the RMA, and at times used by other County Departments, for specialized expertise as needed for specific operations and capital projects. 

 

The recommended action will provide prevailing wage and labor compliance monitoring services as it relates to construction at the East Garrison’s Development Project upcoming Phase 3 Infrastructure Improvements, Phase 2 Inclusionary Housing (CHISPA (Community Housing Improvement Systems and Planning Association, Inc.)), and Phase 3 Vertical Improvements (Residential Houses and Town Center Commercial Development).  Amendment No. 3 to the Agreement with The Labor Compliance Managers will increase the not to exceed amount of $232,400 by $120,000 for a total amount not to exceed $352,400 and extend the expiration date from December 31, 2017 for one (1) additional year through December 31, 2018, for a revised term from December 1, 2013 to December 31, 2018.  Additional time and further extensions beyond the original term authorized per RFQ #10422 may be required on an “as needed” basis to complete all work for this technically complex proposed Project.

 

Attachment E provides a summary of the Agreement to date.

 

DISCUSSION:

To date, the RMA has issued five (5) task orders (TO) to The Labor Compliance Managers to provide prevailing wage and labor compliance monitoring services for discrete portions of the East Garrison Development Project:

The County desires to amend The Labor Compliance Managers’ Agreement to continue to provide prevailing wage and labor compliance monitoring services for the following upcoming portions of the East Garrison Development Project:

                     Phase 3 Library/Sheriff Field Office

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No.3 as to form and legality, and fiscal provisions, respectively.

 

FINANCING:

The FY 17/18 Recommended Budget includes $94,644 in appropriations in Fund 182, Appropriation Unit DEO028 for anticipated costs for expenditures related to Amendment No. 3. Should additional funds be required, RMA will return to the Budget Committee and Board of Supervisors to request additional appropriations. All costs are to be reimbursed by the East Garrison Development Project developer. There is no impact to the County General Fund.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended action complies with the BOS’ FY 2015-16 Strategic Initiative for Economic Development, “Through collaboration, strengthen economic development to ensure a diversified and healthy economy.”, by “Creating better paying jobs, reducing poverty and increasing the revenue base through business expansion while adding to the economic vitality of the County.”
