RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and Authorize the Monterey County Sheriff or Undersheriff to sign a Memorandum of Understanding (MOU) between California State Parks, (hereinafter Cal Parks) and the Monterey County Sheriff’s Office (hereinafter MCSO) addressing joint usage of Cal Parks fueling station for the deputy stationed at Big Sur, at a total not to exceed cost of $12,000 for 12/01/2015 to 11/30/2017. 

 

b.                     Approve and authorize the Sheriff or Undersheriff to approve up to two (2) future amendments to this MOU where the future amendments do not significantly change the scope of work and do not add more than 10% to the MOU, ($1,200) bringing the total not to exceed cost of the MOU to $13,200.

 

SUMMARY:

 

The Monterey County Sheriff’s Office seeks approval of a Memorandum of Understanding with California State Parks (MOU) to allow the deputy stationed at Big Sur to fuel at the Cal Parks fuel station located at Pfeiffer Big Sur State Park. 

 

DISCUSSION:

 

Monterey County Sheriff’s Office (MCSO) began a collaborative arrangement to supply a deputy for the Big Sur area. This county area had been without a full-time deputy for several years, and the request to have a deputy stationed there was made by Cal Parks and the Big Sur community. This proved to be a very beneficial collaboration, especially during the floods and fires and landslides occurring during the past two years.  The deputy was stationed in Big Sur in August 2015, and has resided on site at one of the parks since May 1, 2016.

 

Fueling options in the area are limited. Prior to creation of the fueling MOU, the deputy fueled at the Monterey MCSO Station, which took him away from his assigned law enforcement duties in Big Sur and increased wear and tear on patrol units. The Big Sur area is occasionally inaccessible due to flooding, washed out roads, or other events, so a more practical solution to fueling the deputy’s patrol unit was sought. 

 

Cal Parks offered to let MCSO have access to their fueling facility to fuel the patrol unit and this MOU covering fueling services is the result of this collaboration.  Fuel is more reasonably priced coming from Cal Parks than from other available options in the area and the deputy has access to the fueling station during a longer range of hours, which adds an additional layer of convenience to the arrangement. Cal Parks bills MCSO once a quarter for the fuel dispensed. MCSO had an informal “test” agreement with Cal Parks, which ended 12/1/2015. Significant delays have occurred due to natural disasters occurring in the area and staffing changeovers at Cal Parks, and they agreed to honor the informal agreement until a new agreement could be drafted. 

 

The MOU includes diesel fuel because the deputy now has available to him an all-terrain diesel powered vehicle of which he needs such capabilities periodically.  This is now an operational MOU which requires your Boards approval.

 

A copy of the MOU is on file with the Clerk to the Board.

 

OTHER AGENCY INVOLVEMENT:

 

Cal Parks has already reviewed, agreed to and signed the MOU. County Counsel has approved as to form and the Auditor-Controller has reviewed the MOU as to payment provisions.

 

FINANCING:

This cost was anticipated and included in the FY 2016-17 approved budget and is included in the FY 2017-18 proposed budget. There will be no increase in General Fund Contribution resulting from this board action. Fiscal Year to date, the costs have been less than $700.00. The MOU was written for a larger dollar amount to allow for flexibility of emergency fueling (if fuel is available) for other MCSO units in case of emergency deployment in the area.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

 

This MOU meets the Board’s strategic initiatives by providing cost effective fueling options for the Big Sur deputy. It allows for rapid deployment of the deputy to protect valuable County infrastructure and increases interagency collaboration and cooperation. It allows the deputy to spend more time on task, and therefore, provides a better level of service to the Big Sur community.
